Common use of Official Personnel Files Clause in Contracts

Official Personnel Files. 18.01 There shall be one official personnel file for each Employee to be used in decisions respecting the terms and conditions of employment of that Employee. 18.02 Upon request, by appointment, and upon reasonable notice, Employees shall be given the opportunity to review their official personnel file during normal business hours and in the presence of the Director of Human Resources or designate. At the expense of the Employee, copies of material in the Employee’s official personnel file will be provided upon request. 18.03 The Employer agrees not to introduce as evidence in a hearing relating to disciplinary action any documents from the Employee’s file which the Employee is not aware of at the time of disciplinary action. 18.04 All information in the official personnel files relating to disciplinary matters or to an Employee’s job performance, financial status or health shall be considered confidential and shall not be released without the express written consent of the Employee involved except as required by law or the internal administrative purposes of the University.
