District Personnel File. The District will maintain an official District personnel file/record in the Office of Human Resources for each teacher. Although not necessarily maintained in the same location, the District will keep separate sub-files of each individual’s personnel file. Examples of information that could be in such sub-files are: 1) health records and documents; 2) documents related to grievances; 3) documents related to administrative leaves; and 4) documents related to disciplinary measures. Access to these sub- files/records will be restricted to only those District employees who have a need for such access as determined by the Assistant Superintendent of Human Resources. Anytime these types of personnel files/records are accessed for a purpose which may negatively affect the teacher, the teacher will be notified of the identity of the person accessing the file and the purpose for that access within two (2) workdays unless the teacher would have already been aware of such access.

District Personnel File. 8.1 Each unit member shall have the right, upon request, to review the material in his/her own personnel file during non-duty hours. In the case of eight (8) hour employees the employee shall be released for a reasonable time mutually agreeable with the supervisor for this purpose. Such release during the workday shall be without salary reduction. Material available for review shall not include ratings, reports, or records which:

District Personnel File. Employees shall have the right, upon reasonable notice, to inspect the contents of their personnel file. Inspection shall be in the presence of a District representative. File materials shall be reproduced for the employee as promptly as feasible, if requested. The employee shall pay for the expense of such reproduction in cases of litigation against the District. No materials derogatory of the employee's conduct, service, character, or personality, shall be placed in the file unless the employee has opportunity to read them. The employee shall acknowledge having read the material by affixing his or her signature to the actual copy to be filed. Such signature shall not signify that the employee agrees with the content of the material. Such materials shall be removed upon request of the employee from the file after three (3) years of its inclusion in the file provided no incident of a similar nature occurs during this three (3) year period, except where prohibited by state (RCWs) and federal law and/or the Washington Administrative Code (WACs) and OSPI memorandums. Materials may be retained if they represent serious misconduct or potential legal liability for the District. If the District decides to place materials in the personnel file, the employee shall have the right to answer any material filed and his or her answer shall be reviewed and signed by a District representative and attached to the file copy of the pertinent material. The District representative's signature shall not signify agreement with the rebuttal. No material from the file shall be duplicated and furnished to any agency or individual without the permission of the employee involved. Public information normally available will be an exception to this rule. An Association representative at the employee's request may be present during a review of said employee's file.

  • Personnel File (a) An employee, or the President of the Union (or the President's designate) with the written authority of the employee, shall be entitled to review an employee's personnel file, in the office in which the file is normally kept. The employee or the President, as the case may be, shall give the Employer adequate notice prior to having access to such files.

  • Contents of Personnel File A. Adverse statements prepared by the County shall not be included in an employee's official personnel file unless a copy is provided to the employee.

  • Personnel Files ‌ An employee, or his/her certified representative with the written consent of the employee, may inspect that employee's personnel file with the exception of all material obtained from other employers and agencies at the time that employee was hired. An employee shall be advised of, and entitled to read, any written statement by the employee's supervisor or departmental Management regarding his/her work performance or conduct if such statement is to be placed in his/her personnel file. The employee may file a grievance regarding any such document within the prescribed time limits of the grievance procedure. If the employee fails to file a grievance within the designated time limits, the document becomes part of the official file. If the employee does file a grievance within the designated time limits, said document shall not be placed in the official file nor referenced in any Performance Evaluation or Appraisal of Promotability until the grievance procedure or civil service appeal rights have been exhausted. Grievances filed under this provision shall not be subject to the Arbitration provisions of the Grievance Procedure unless they involve violation of a specific provision of this agreement. Management agrees that no properly used full paid sick leave used in the twelve months immediately prior to an Appraisal of Promotability or a Performance Evaluation will be referenced on such forms. The employee may attach his/her statement to any document within twenty (20) business days if he/she chooses not to file a grievance regarding such document or within ten (10) business days following final determination if he/she has filed a grievance regarding such document. On reviewing his/her personnel file, an employee may request and have any written warnings issued more than one year prior placed in an envelope and sealed in his/her personnel file except as such may be a part of an official permanent record. On the face of the sealed envelope it shall read "The contents herein shall be disclosed only upon written consent of the subject employee or by subpoena or other legal process from a public body of competent jurisdiction." The date the contents of the sealed envelope will be destroyed shall also appear on the face of envelope. That date shall be two (2) years from the date of issue of the documents in the sealed envelope. An employee on reviewing his/her personnel file, may request and have any written warnings or reprimand(s) issued more than two (2) years prior removed from his/her personnel file except as such may be a part of an official permanent record. All departments employing peace officers covered by the Peace Officers Bill of Rights shall comply with its provisions.
