On Recall. Employees recalled to work at Poplar River Mine Will be entitled to the following benefits: Vac. Pa Pension In the event of the lay off of an employee in respect of whom it is subsequently established that the lay off was not in accordance with the provisions of the Agreement, and provided a grievance has been submitted in accordance with Article of this Agreement, such employee shall be promptly returned to former status in all respects (or to such other positionswith the that the employee's seniority would entitle the employee to under the terms of this Agreement) and shall be compensated for the net loss of earnings suffered by reason of lay off
