Open Source Libraries. The use and operation of the Licensed Software may require the concurrent use of the Open Source Libraries listed at the following hyperlink: xxxxx://xxxxxxxxx.xxxxxxxxx.xxx/doc/PolyWorksAcknowledgments.pdf (the "List of Open Source Libraries"). Licensee acknowledges that InnovMetric shall be entitled to update the List of Open Source Libraries, as the use of Open Source Libraries varies upon each new release. InnovMetric represents and warrants that it has the right to authorize the use of such Open Source Libraries by Licensee in conjunction with the Licensed Software, in full compliance with the licensing terms of such Open Source Libraries. Where and to the extent required pursuant to the licensing terms of such Open Source Libraries, InnovMetric will provide or make available a copy of the source code of such Open Source Libraries to Licensee. Licensee's use of such Open Source Libraries is governed by the terms of this Agreement, not the usual licensing terms of such Open Source Libraries. InnovMetric represents and warrants that it is authorized to license the use of such Open Source Libraries as per the terms of this Agreement. Licensee releases all third-party owners or licensors of such Open Source Libraries of any and all liability flowing from representations, conditions, warranties and covenants made or provided pursuant to this Agreement that go above and beyond those representations, conditions, warranties and covenants made or provided under the usual licensing terms of such Open Source Libraries, as applicable between InnovMetric and such third-party owners or licensors.

Open Source Libraries. SOFeXchange may include or require certain third-party, open source components or libraries ("THE OPEN SOURCE LIBRARIES").
Open Source Libraries. The open source libraries included in the Software are done so pursuant to each individual open source library license and subject to the disclaimers and limitations on liability set forth in each open source library license. The open sources library licenses may not be Handsoncode products or software. For that reason, the Licensee acknowledges that Handsoncode do no warranties their content, conditions or usability for the Licensee purposes. Open Source Libraries. Customer understands that its ability to use the Software may require use of open source code libraries, (“OSS Libraries”). Current open source components made available by Rapid7 can be found at: xxxxx://xxxx.xxxxxxxxxx.xxx/docs/oss), however Customer may elect to use such OSS Libraries or procure alternatives. Customer acknowledges that its use of the third party software in connection with the Software and access to and use of OSS Libraries (whether or not access to such OSS Library is provided by Rapid7) may be subject to separate third party license terms and conditions (“Third Party Terms”). Notwithstanding anything set forth in this Agreement, Customer agrees that (a) all such third party software and access to and use of OSS Libraries is governed exclusively by the applicable Third Party Terms, and Customer shall comply with all Third Party Terms, and (b) Licensor shall have no obligation to provide any OSS Libraries (or rights to use the same).

  • Open Source Code “Open Source Code” shall mean any software code that is distributed as “free software” or “open source software” or is otherwise distributed publicly in source code form under terms that permit modification and redistribution of such software. Open Source Code includes software code that is licensed under the GNU General Public License, GNU Lesser General Public License, Mozilla License, Common Public License, Apache License, BSD License, Artistic License, or Sun Community Source License.

  • Open Source Software The Software product may include certain open source components that are subject to open source licenses (“Open Source Software”), in which case, the embedded Open Source Software is owned by a third party. The Open Source Software is not subject to the terms and conditions of this XXXX. Instead, each item of Open Source Software is licensed under its applicable license terms which accompanies such Open Source Software. Nothing in this XXXX limits your rights under, nor grants you rights that supersede, the terms and conditions of any applicable license terms for the Open Source Software. Any fees charged by GC in connection with the SOFTWARE, do not apply to the Open Source Software for which fees may not be charged under the applicable license terms. The terms and conditions of the applicable license for the Open Source Software are available on the LICENSE.txt file, which is provided with the SOFTWARE.

  • OPEN SOURCE COMPONENTS The DS Offerings may include open source components. Whenever notices (such as acknowledgment, copies of licenses or attribution notice) are required by the original licensor, such notices are included in the Documentation of the DS Offerings. Moreover, some open source components may not be distributed and licensed under the terms of the Agreement but under the terms of their original licenses as set forth in the Documentation of the DS Offerings themselves. Source code for open source software components is available upon request. Except for components mentioned in the section EXCLUSIONS below, the warranty and indemnification provided by DS under the Agreement apply to all open source software components and shall be provided by DS and not by the original licensor, but only for the use of the DS Offerings that is in compliance with the terms of the Agreement, and in conjunction with the DS Offerings. The original licensors of said open source software components provide them on an “as is” basis and without any liability whatsoever to Customer.

  • Open Source 15.1 All software created for the Buyer must be suitable for publication as open source, unless otherwise agreed by the Buyer. 15.2 If software needs to be converted before publication as open source, the Supplier must also provide the converted format unless otherwise agreed by the Buyer.

  • Third Party Software The Software may contain third party software which requires notices and/or additional terms and conditions. Such required Third Party Software notices and/or additional terms and conditions are located at xxxxx://xxx.xxxxxxxxxxxxxx.xxx/xxxx-third-party/ (or a successor website thereto) and are made a part of and incorporated by reference into this Agreement.

  • Antivirus software All workstations, laptops and other systems that process and/or store PHI COUNTY discloses to CONTRACTOR or CONTRACTOR creates, receives, maintains, or transmits on behalf of COUNTY must have installed and actively use comprehensive anti-virus software solution with automatic updates scheduled at least daily.

  • Software License The SOFTWARE is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE is licensed, not sold.

  • SOFTWARE PRODUCT LICENSE The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.

  • Source Code 5.1 Nothing in this XXXX shall give to the User or any other person any right to access or use the Source Code or constitute any licence of the Source Code.

  • Software Licenses Seller has all necessary licenses to use all material third-party software used in Seller's business, and Seller's use of third-party software does not infringe the rights of any Person.
