Operation as a Public Airport. The Authority covenants and agrees that all times it will operate and maintain the Airport, as a public Airport consistent with and pursuant to the sponsor’s assurances given by the Authority to the United States Government under the Federal Aviation Act.

LESSOR covenants and agrees that at all times it will operate and maintain the Airport, except as limited by applicable laws, ordinances, regulations, rulings and other governmental requirements, as a public airport consistent with and pursuant to the Sponsor’s Assurances given by LESSOR to the United States Government under the Federal Airport Act. Operation as a Public Airport. The Aviation Commission covenants and agrees that, at all times, relevant to this Agreement, it will operate and maintain the Airport facilities, as defined hereinabove, as a public airport consistent with and pursuant to the Sponsor's Grant Assurances given by the Aviation Commission to the U.S. Government under the Federal Airport Act and consistent with the terms and conditions of this Agreement. The Aviation Commission further covenants and agrees to manage the Airport in a reasonable and prudent manner and to use due diligence in the operation and maintenance of Airport facilities.
Operation as a Public Airport. Landlord covenants and agrees that at all times it will operate and maintain the Airport as a public airport consistent with and pursuant to the sponsor's assurances given by the Landlord to the United States Government under the Federal Airport and Airways Act.
