Operation By Third Parties. If any portion of the Mortgaged Property is comprised of interests which are not working interests or which are not operated by the Mortgagor or one of its Affiliates, then with respect to such interests and properties, the Mortgagor’s covenants as expressed in this Article IV are modified to require that the Mortgagor use reasonable commercial efforts to obtain compliance with such covenants by the working interest owners or the operator or operators of such Mortgaged Properties.
Operation By Third Parties. All or portions of the Mortgaged Property may be comprised of interests in the Hydrocarbon Property which are other than working interests or which may be operated by a party or parties other than Mortgagor and with respect to all or any such interests and properties as may be comprised of interests other than working interests or which may be operated by parties other than Mortgagor, Mortgagor's covenants as expressed in this Article III are modified to require that Mortgagor use its best efforts to obtain compliance with such covenants by the working interest owners or the operator or operators of such leases or properties.

If any portion of the Deed of Trust Property is comprised of interests which are not working interests or which are not operated by the Trustor or one of its Affiliates, then with respect to such interests and properties, the Trustor’s covenants as expressed in this Article III are modified to require that the Trustor use reasonable commercial efforts to obtain compliance with such covenants by the working interest owners or the operator or operators of such Deed of Trust Properties.
Operation By Third Parties. All or portions of the Mortgaged Property may be comprised of interests in the Hydrocarbon Property which may be operated by a party or parties other than Borrower or its Affiliates, and with respect to all or any such interests and properties which may be operated by parties other than Borrower or its Affiliates, Borrower's covenants as expressed in this ARTICLE III are modified as follows: to the extent Borrower has Knowledge of noncompliance, Borrower shall use its commercially reasonable efforts to obtain compliance with such covenants by the working interest owners or the operator or operators of such leases or properties (to the extent required by the operating or other agreements to which they are subject).

All or portions of the Mortgaged Property may be comprised of interests in the Subject Interest which are other than working interests or which may be operated by a party or parties other than Mortgagor and with respect to all or any such Subject Interests and properties as may be comprised of interests other than working interests or which may be operated by parties other than Mortgagors, Mortgagors’ covenants set forth in as expressed in Paragraph F are modified to require that Mortgagors use commercially reasonable efforts to obtain compliance with such covenants by the working interest owners or the operator or operators of such Subject Interest.
Operation By Third Parties. All or portions of the Mortgaged Property may be comprised of interests in the Hydrocarbon Property which are other than working interests or which may be operated by a party or parties other than Grantor and with respect to all or any such interests and properties as may be comprised of interests other than working interests or which may be operated by parties other than Grantor, Grantor shall further use its best efforts to obtain compliance with all covenants of Grantor herein by the working interest owners or the operator or operators of such leases or properties, to the extent that it has the ability to cause the operator or operators to do so.
Operation By Third Parties. In the event that all or any portions of the Mortgaged Property is comprised of interests in the Hydrocarbon Property which are not working interests or which are operated by a party or parties other than Mortgagor, then, with respect to such interests and properties, Mortxxxxx'x xovenants as expressed in this Article III are modified to require that Mortgagor use reasonable efforts consistent with usual and customary industry practice to obtain compliance with such covenants by the working interest owners or the operator or operators of such leases or properties.
Operation By Third Parties. To the extent any of the Mortgaged Property is operated by a party or parties other than Trustor, Trustor's covenants as expressed in this Section IV are modified to require that Trustor use its best efforts (including without limitation the reasonable exercise of all rights and remedies as are available to Trustor) to obtain compliance with such covenants by the operator or operators of the Mortgaged Property.
Operation By Third Parties. All or portions of the Mortgaged Property may be comprised of interests in the Hydrocarbon Interests pledged hereunder which are other than working interests or which may be operated by a party or parties other than Mortgagor and with respect to all or any such interests and properties as may be comprised of interests other than working interests or which may be operated by parties other than Mortgagor, Mortgagor shall not be obligated to perform any undertakings contemplated by the covenants and agreements contained herein that any Responsible Officer of Mortgagor reasonably believes are (a) performable only by such working interest owners or operators or (b) beyond the control of Mortgagor; however, Mortgagor agrees to promptly take, or cause to be taken, all reasonable actions available under any operating agreements or otherwise to bring about the performance of any such material undertakings required to be performed hereunder.
Operation By Third Parties. All or portions of the Deed of Trust Property may be comprised of interests in the Hydrocarbon Property which are other than working interests or which may be operated by a party or parties other than Mortgagor and with respect to all or any such interests and properties as may be comprised of interests other than working interests or which may be operated by parties other than Mortgagor, Xxxxxxxxx’s covenants as expressed in this Article III are modified to require that Mortgagor uses commercially reasonable efforts to obtain compliance with such covenants by the working interest owners or the operator or operators of such leases or properties, to the extent that it has the ability to cause the operator or operators to do so.
