Tolerance Average net mass of cement packed in bags in a sample shall be equal to or more than 50kg. If and as desired by the Engineer-in-Charge, the number of samples to be checked for net mass of cement per bag, in a given number of bags shall be as given below: 100 to 150 bags : 20 sample 150 to 280 bags : 32 sample 281 to 500 bags : 50 sample 501 to 1200 bags : 80 sample 1201 to 3200 bags : 125 sample 3201 and above : 200 sample The bags in a sample shall be selected at random.
Outputs Analogue and digital outputs of protected content are allowed if they meet the requirements in this section and if they are not forbidden elsewhere in this Agreement..
Year 2000 Compatibility Take all action necessary to assure that its computer based systems are able to operate and effectively process data including dates on and after January 1, 2000, and, at the reasonable request of the Administrative Agent or the Required Lenders, provide evidence to the Lenders of such year 2000 compatibility.

Objective The objective of DST’s Security Policy and related information security program is to implement data security measures reasonably designed in material respects to be consistent with applicable prevailing industry practices and standards (“Objective”). In order to meet such Objective, DST uses commercially reasonable efforts to: a. Protect the privacy, confidentiality, integrity, and availability of all confidential data and information disclosed by or on behalf of Fund to, or otherwise comes into the possession of DST, in connection with the provision of services under the Agreement and to the extent the same is deemed confidential information under the terms of the Agreement (collectively, “Fund Data”). For the avoidance of doubt, and without limiting the foregoing, “Fund Data” includes all Confidential Information of the Fund and its agents or service providers, including, without limitation all “Customer Information,” as contemplated in the Agreement; b. Protect against accidental, unauthorized, unauthenticated or unlawful access, copying, use, processing, disclosure, alteration, transfer, loss or destruction of the Fund Data; c. Comply with applicable governmental laws, rules and regulations that are relevant to the handling, processing and use of Fund Data by DST in accordance with the Agreement; and d. Implement customary administrative, physical, technical, procedural and organizational safeguards. e. Implement means and technology to encrypt Fund Data, mutually acceptable between the Fund and DST, while in transit to and from DST.

Industry Troubleshooter Where a difference arises between the parties relating to the dismissal, discipline, or suspension of an employee, or to the interpretation, application, operation, or alleged violation of this Agreement, including any question as to whether a matter is arbitrable, during the term of the Collective Agreement, Xxxxx XxXxxxxxxx, Xxxx Xxxxxx, Xxxxx Xxxxxxxx, or a substitute agreed to by the parties, shall at the request of either party:
Solution The Supplier’s contractually committed technical approach for solving an information technology business objective and associated Requirements as defined and authorized by the scope of the Contract or any order or Statement of Work issued under the Contract. Solution means all Supplier and Supplier’s third-party providers’ components making up the Solution, including but not limited to Software, Product, configuration design, implementation, Supplier-developed interfaces, Services and Work Product.
Parameters In calculating the MtM Exposure for each Transaction, the following parameters are set on the Transaction Date: ▪ On-Peak Initial Xxxx Xxxxx ▪ Off-Peak/On-Peak Price Ratio ▪ Off-Peak Initial Xxxx Xxxxx ▪ MW-Measure: initial Capacity PLC Per Tranche ▪ On-Peak Estimated Energy Quantity Per MW-Measure for each of the twelve calendar months ▪ Off-Peak Estimated Energy Quantity Per MW-Measure for each of the twelve calendar months ▪ Number of awarded Tranches In calculating the MtM Exposure for each Transaction, the following parameters are set each Business Day subsequent to the Transaction Date: ▪ On-Peak Forward Price ▪ Off-Peak Forward Price ▪ Current Capacity PLC Per Tranche ▪ On-Peak Estimated Energy Quantity ▪ Off-Peak Estimated Energy Quantity Process to Update the On-Peak Initial Mark Prices and Off-Peak Initial Mark Prices on a Daily Basis On each Business Day subsequent to the Transaction Date, the Pricing Agent will contact four Reference Market-Makers to obtain price quotes for on-peak and off-peak energy for PJM Western Hub. The Pricing Agent may not rely upon quotes from Seller or any Affiliate of Seller. The updated mark for a month will be equal to the average mark for that month over all sources from which a quote is available. If a monthly quote is available from any source, only the monthly quote or monthly quotes shall be used. Where quotes provide a bid and ask, the average shall be used. Where a quote for an individual month is unavailable, but the month is quoted as part of a “packaged” quote (e.g., January 2011 is only available in the form of a January/February 2011 “packaged” quote or an annual quote): ▪ If the other month/months of the package quote is/are also unavailable, then the marks for all months of the package will be calculated by multiplying the packaged quote by the ratio of the corresponding month to the corresponding calculated package quote from the previous day. Example: There are no On-Peak quotes available on day X during the contract for July 2011 or August 2011. However, there is an On-Peak July/August 2011 packaged quote of $73.00/MWh available. The On-Peak marks from day X-1 for July 2011 and August 2011 were $73.50/MWh and $76.50/MWh respectively. The day X On-Peak mark for July 2011 is set at 73.00 * [73.50] / [( (73.50 * 352) + (76.50 * 336) ) / (352+336) ] = 73 * (73.50/ 74.97) = $71.57/MWh. The day X On-Peak mark for August 2011 is set at 73.00 * [76.50] / [( (73.50 * 352) + (76.50*336) ) / (352+336) ] = 73 * (76.50 / 74.97) = $74.49/MWh. ▪ If the other month/months of the package quote is/are available, then the mark for the month will be set such that the average of the month and the other month(s) (weighted for either the On-Peak Hours or Off-Peak Hours as applicable) equals the packaged quote (see calculation example below).
