Common use of Paid Disability Leave Clause in Contracts

Paid Disability Leave. Paid Disability Leave shall be defined as a leave in excess of five (5) working days in which payment shall be received from the employee’s leave time accruals (sick, vacation or personal) or covered by Short-Term Disability. To be eligible for a paid disability leave, employees must follow the procedures established by the University as administered by a third-party administrator. The University reserves the right to challenge the disability qualifications of employees requesting paid disability leave. In the event there is a dispute over the disability qualifications between the University and the employee, the dispute shall be processed through the medical dispute procedure as provided in paragraph 140. Should the employee choose not to follow the medical dispute procedure, the employee shall forfeit their eligibility for paid disability leave.
