Temporary Disability Leave. Upon application, and approval by the school employer, a temporary disability leave of absence shall be granted to teachers of this school corporation on the following basis:
Temporary Disability Leave. A temporary disability shall be considered hereunder as any disabling medical condition which precludes an employee from performing the duties of his job position for a temporary period of time. An employee who is or expects to be temporarily disabled must notify the Department of Human Resources and his school principal or supervisor in writing. Notice must be given at the earliest possible date after an employee becomes aware of the disability. An employee anticipating a temporary disability, but not yet on leave, shall be permitted to continue employment provided the employee’s physician certifies that the employee is physically capable of performing his regular employment duties. The employee must also submit a physician’s certificate indicating the date the disability has commenced and certifying that the employee will be temporarily unable to work. An employee temporarily disabled must submit written verification to the School Board every six (6) weeks of the continued existence of the temporary disability. Verification shall include certification from the employee’s attending physician that the employee is temporarily unable to return to work along with a current diagnosis, treatment plan, and a projected return-to-work date. Failure to provide this information may result in denial of leave or extension of leave without pay. Any question regarding whether the claimed disability is bona fide will be resolved by a Board appointed physician who shall examine the employee and render a report on his findings. Employees shall apply unused sick leave and may use vacation time, if needed, toward any temporary disability, commencing with the first day of absence from work until such time that accumulated sick leave days and any used earned vacation days are exhausted. Employees whose temporary disabilities are longer in duration than six (6) consecutive working days and who exhaust all of their accumulated sick leave days and any of their used earned vacation days, and whose continuing disabilities are not being compensated under Section 19:04 of this Agreement shall be granted a temporary disability leave without pay for the duration of their temporary disabilities, but not to exceed one (1) year. Temporary Disability Leave. Temporary disability leave will be granted to a permanent employee who is precluded from performing their job duties because of a disability. Temporary disability leave includes a serious health condition of the employee as provided in Article 16.
A. Temporary disability leave will run concurrently with leave granted under Article 16, Family and Medical Leave. Temporary disability leave will not total more than twelve (12) months or two thousand, eighty-eight (2088) straight-time hours. For the purposes of intermittent use (i.e. when temporary disability leave is not taken continuously), each hour taken will be deducted from the balance of temporary disability leave available.
B. The temporary disability and recovery period will be as defined and certified by the employee's licensed health care provider. The employee will provide, in a timely manner, a copy of such certification to the Employer. The Employer may require employees to exhaust all paid leave prior to using any leave without pay for temporary disability leave, except that the employee will be allowed to use eight (8) hours per month of accrued paid leave during each month of temporary disability leave to provide for continuation of benefits as provided by the Public Employees Benefits Board. The Employer will designate on which day of each month the eight (8) hours paid leave will be used.
Temporary Disability Leave. Employees who are physically unable to perform the functions of their position for medical reasons, may be placed on temporary disability leave. Temporary disability leave shall be granted for illness, injury, surgery, or because of pregnancy or childbirth and shall only be granted for the period of actual disability and shall not exceed one (1) year, or two (2) years in the event of an on-the-job injury.
Section 9.7.1 The employee shall notify his/her immediate supervisor and the Human Resources Department of his/her temporary disability. If possible, such notification shall be made at least sixty (60) calendar days prior to the proposed starting date of the leave. The actual starting date of the leave shall be determined as necessary to protect the quality of the instructional and supportive programs, the desire of the employee and the employee's attending physician. The Employer may require a doctor's certification that the employee is able to continue to work prior to the temporary disability leave without jeopardizing the employee's health or the safety of others.
Section 9.7.2 Expiration of the temporary disability leave shall be when the employee's attending physician confirms the ability of the person on temporary disability leave to resume the duties of the assigned position. The Employer may, in its discretion and at its own expense, have the employee examined by a doctor of the Employer's choice at any time.
Section 9.7.3 Upon expiration of temporary disability leave, the employee shall be assigned to the same position, or to an equivalent position, occupied before the leave, if such leave is granted due to a job-related injury, or the leave does not go beyond ninety

Temporary Disability Leave. In compliance with FMLA benefits and upon application, the Board shall grant a temporary disability leave of absence to teachers of this school corporation on the following basis:
Temporary Disability Leave a. A Teacher may request approval of an unpaid temporary disability leave for a period of time during which a physician certifies that the Teacher is unable to perform their regular teaching duties.
b. The Board may approve temporary disability leave subsequent to a Teacher’s utilization of all or any portion of their accumulated paid sick leave days.
c. The Board may approve temporary disability leave for the duration of the illness, not to exceed one (1) school year. The Board may grant consecutive temporary disability leaves to a Teacher, as is appropriate.
Temporary Disability Leave. The District shall grant to an employee who for medical reasons (physical or mental) cannot perform her/his duties, a temporary disability leave with or without pay under the following provisions:
Temporary Disability Leave. The provisions of Division III, Section 11.4 of the District’s Administrative Code Personnel Policies and Procedures are incorporated herein, and made a part hereof by this reference. Proposed changes to this policy that are within the scope of bargaining will not be implemented without first obtaining the concurrence of the Association in said changes.
Temporary Disability Leave. Accrued leave days up to maximum accumulated may be used to cover absence caused by physical or mental disability or pregnancy not covered by the long term disability provision or FMLA. However, any other supplemental income derived from a Board subsidized plan as a result of such disability shall be an off-set to any payments under this section. Period of leave shall be only during calendared teacher/ancillary staff duty days, shall be as determined by the Board based on medical certification and leave shall terminate not later than June 15 of the school year during which leave commenced.
(a) Disability leave days shall be used only for days certified by a doctor that a teacher/ancillary staff is disabled and then only to the extent that a teacher/ancillary staff has accumulated accrued leave days.
