Parallel School Disciplinary Proceedings. It is understood and agreed that school officials have an independent right and responsibility to initiate and pursue disciplinary proceedings or to remove a student from the regular educational program under certain circumstances, including but not limited to those specified in the “Zero Tolerance for Guns Act,” Chapter 127 of the laws of 1995. It is further understood and agreed that all school-based disciplin- ary proceedings are separate and distinct from any juvenile or adult criminal pros- ecution; that law enforcement agencies shall not require or request school officials to undertake a disciplinary action against a student; and that the imposition of sanc- tions by both schools and by the juvenile justice system based upon a single infrac- tion or event in no way constitutes “double jeopardy.”
