PARTICIPANT VOLUNTARY CONTRIBUTIONS. This Plan does not permit Participant voluntary contributions (which are nondeductible employee contributions) unless the Employer maintains its Plan under a Code Section 401(k)
PARTICIPANT VOLUNTARY CONTRIBUTIONS. (a) If elected in item 9 of the Adoption Agreement (Profit Sharing Plan) or item 8 of the Adoption Agreement (Pension Plan), a Participant may voluntarily contribute to the Plan an amount up to ten percent (10%) of his aggregate Compensation for all years since becoming a Participant under this Plan and all other qualified plans of the Employer. Any Participant Voluntary Contributions shall be limited in accordance with the provisions of Section 5.3, even if the Employer does not elect the Cash or Deferred Arrangement (Section 401(k)) under item 8 of the Adoption Agreement (Profit Sharing Plan). If the Profit Sharing Plan is elected, all Participant Voluntary Contributions shall be deemed made to such plan. Participant Voluntary Contributions shall be limited to Participants who are not highly compensated employees (within the meaning of Code Section 414(q)) if elected in the Adoption Agreement. (b) A Participant shall be entitled to withdraw from his appropriate Account at any time upon thirty (30) days' notice from the Administrator to the Custodian (which notice shall specify the amount of the withdrawal), a sum not in excess of the capital amount contributed by him as Participant Voluntary Contributions under the provisions of this Section 4.3, or the value of such Account, whichever is less, provided that no ordinary income or capital gains attributable to such contributions shall be subject to withdrawal. Notwithstanding anything to the contrary herein, (i) all withdrawals are subject to the provisions of Article VIII, and (ii) no forfeiture shall occur solely as a result of a Participant's withdrawal of all or any portion of his Participant Voluntary Contributions. (c) No deductible voluntary employee contributions may be made for taxable years beginning after December 31, 1986. Such contributions made prior to that date will be maintained in a separate Account which will be nonforfeitable at all times. The Account will share in the gains or losses in the same manner as described in Section 9.3
