Past Due Rent and Additional Rent. If Tenant shall fail to pay, when the same is due and payable, any Rent or any Additional Rent, or amounts or charges of any character whatsoever owed to Landlord, such unpaid amounts shall bear interest from the due date thereof to the date of payment at the rate which is the lesser of (i) eighteen percent (18%) per annum, or (ii) the maximum interest rate permitted by law (the "Default Rate").

Past Due Rent and Additional Rent. If Tenant shall fail to pay, when the same is due and payable, any rent or any additional rent, or amounts or charges of the character described in Section 2.5 hereof, such unpaid amount shall bear interest from the due date thereof to the date of payment at the rate of two percent (2x) per month.

The late charge shall accrue daily until the unpaid Rent (including the late charge) is paid. Tenant agrees that such amounts are not a penalty, but are intended as liquidated damages and reflect a reasonable estimate by the parties of the cost to reimburse Landlord for the loss of the use of the money and the additional administrative costs resulting from late payments. Tenant shall also be responsible for the payment of reasonable attorneys' fees incurred by Landlord in collecting any delinquent Rent from Tenant. Any election by Landlord to waive in any instance the requirement for Tenant's payment of late charges and/or attorneys' fees incurred by Landlord pursuant to this Section of any other provision in this Lease shall not operate to waive or impair Landlord's right to collect such sums from Tenant upon any other breach of Tenant's obligations under this Lease.

Landlord may after two (2) such returned checks during the Lease Term, at its sole option, insist upon payment of any sums due hereunder thereafter (including, without limitation, the monthly Rent) by cashier's check or certified funds only. If Tenant shall fail to pay, when the same is due and payable, any Rent, including the amounts or charges of the character described in Section 3.04 hereof, such unpaid amounts shall bear interest from the due date thereof to the date payment is received in hand by Landlord at the rate which is the greater of eighteen (18.0%) percent per annum or the maximum interest rate permitted by law.

Past Due Rent and Additional Rent. If Tenant shall fail to pay, when the same is due and payable, any Rent or any Additional Rent, or amounts or charges of the character described in Section 3.03 hereof, Tenant shall pay as Additional Rent a late fee equal to six (6%) percent of the delinquent amount if such payments are not paid within five days of their due date. Landlord and Tenant agree that this late charge represents a reasonable estimate of the costs and expenses Landlord will incur and is fair compensation to Landlord for its loss suffered by reason of late payment by Tenant.
