Common use of Pay Instead of Vacation Clause in Contracts

Pay Instead of Vacation. Fire Prevention employees may sell back a portion of their vacation that is earned each year in accordance with the following rules: (a) Employees who have earned and accumulated 80 vacation hours or more in any one anniversary year are eligible to sell back up to one half of that year’s accrued vacation balance (one request per year). To qualify for payment the employee must take a minimum of 40 consecutive hours of vacation in the current anniversary year, provided a maximum accumulation of 200 hours is not exceeded. (b) No payment will be provided for any accrued vacation in excess of two hundred (200) hours. No time off will be provided in excess of two hundred hours per anniversary year.
