Common use of Pay Status of Employees Clause in Contracts

Pay Status of Employees. 32 Time spent at the collection site for an alcohol and/or controlled substance test, 33 including necessary travel time, will be considered as work time. The Employer 34 shall pay for the cost of drug and/or alcohol tests administered under the random, 35 post-accident, and reasonable suspicion testing provisions of the Act or a test 36 required when a current employee enters or re-enters the testing pool, except that 37 the Employer may not be responsible for the cost of any split sample testing related 38 to such tests. See Article 53, Section D.1. 1 Employees tested under the reasonable suspicion provisions for controlled 2 substance use may be removed from the work site and placed on available leave 3 credits until receipt of the drug test results. In the event that the test results are 4 negative, the leave credits will be restored and the employee shall be considered 5 to have been in work status for the period of the absence from regularly scheduled 6 work activities.
