Employees working in managerial, confidential, or supervisory positions, or any positions excluded by the Civil Service Rules and Regulations, shall not be covered by the terms and conditions of this Agreement.
Representation Units. All licensed and registered group family and family child care providers outside the five boroughs of New York City as defined in Executive Order # 12 section 2, group (c) as signed on May 8, 2007, hereafter referred to as the VOICE/CSEA representation unit.

2. The employees covered by this Settlement shall be those permanent employees holding classifications assigned by the State Personnel Director to the certified units, as set forth in Appendices A, B, C and D of this Settlement and such other classifications as may be assigned to the respective appropriate units, by the State Personnel Director, under Executive Order 90-6, or by subsequently enacted legislation. Some employees in these classifications may be included and others excluded depending on specific duties of the positions.
3. The State shall continue to recognize the Union as the exclusive representative for the employees in the units set forth above when collective bargaining legislation covering State Executive Branch employees is enacted unless specifically directed otherwise by legislation.
Representation Units. The parties recognize that it is in the public interest, as well as the interests of employees and employers, to avoid multiplicity and/or proliferation of bargaining units. To this end, Wishard Health Services has established an employee classification system on a system-wide basis for all employees to reflect the broadest lines of organization. The parties further recognize system-wide employee classifications as the most appropriate bargaining units. Accordingly, Wishard Health Services agrees to recognize Local 2065 of the American Federation of Hospital, County and Municipal Employees, AFL-CIO, Indiana Council 62 as the exclusive bargaining agent for a bargaining unit including:
