Representation Units. The Employer recognizes the Union as the exclusive representative and sole bargaining agent for the Bargaining Units of employees represented by the following certifications of the State Personnel Director: Human Services Unit - certified November 17, 1985. Administrative Support Unit - certified November 17, 1985. The employees covered by this Agreement shall be those in the classifications listed in Appendices A & B of this Agreement and such other classifications as may be assigned to the respective Units under the Civil Service Rules and Regulations and/or in accordance with the provisions of this Agreement. Employees working in managerial, confidential, or supervisory positions, or any positions excluded by the Civil Service Rules and Regulations, shall not be covered by the terms and conditions of this Agreement.
Representation Units. The parties recognize that it is in the public interest, as well as the interests of employees and employers, to avoid multiplicity and/or proliferation of bargaining units. To this end, Wishard Health Services has established an employee classification system on a system-wide basis for all employees to reflect the broadest lines of organization. The parties further recognize system-wide employee classifications as the most appropriate bargaining units. Accordingly, Wishard Health Services agrees to recognize Local 2065 of the American Federation of Hospital, County and Municipal Employees, AFL-CIO, Indiana Council 62 as the exclusive bargaining agent for a bargaining unit including:

The State recognizes the Union as the exclusive negotiating organization for the appropriate units of employees represented by the following; certifications of the Public Employees Relations Board (PERB): Unit 1: Labor, trades and crafts, certified October 22, 1990. Unit 2: Administrative and technical support, certified February 7, 1991. Unit 3: Regulatory, inspection and licensure nonprofessional, certified October 23, 1990. Unit 10: Public safety, protective service workers, and institutional security, certified October 23, 1990. 2. The employees covered by this Settlement shall be those permanent employees holding classifications assigned by the State Personnel Director to the certified units, as set forth in Appendices A, B, C and D of this Settlement and such other classifications as may be assigned to the respective appropriate units, by the State Personnel Director, under Executive Order 90-6, or by subsequently enacted legislation. Some employees in these classifications may be included and others excluded depending on specific duties of the positions. 3. The State shall continue to recognize the Union as the exclusive representative for the employees in the units set forth above when collective bargaining legislation covering State Executive Branch employees is enacted unless specifically directed otherwise by legislation.
Representation Units. All licensed and registered group family and family child care providers outside the five boroughs of New York City as defined in Executive Order # 12 section 2, group (c) as signed on May 8, 2007, hereafter referred to as the VOICE/CSEA representation unit.

  • Representations and Warranty 8.1 You represent and warrant that you and the Representative, will perform all activities relating to the Service: (a) in accordance with Best Industry Practice and in a professional and lawful manner; (b) if applicable, using appropriately skilled and experienced Representatives whose identity, address and right to live and work in Bermuda and (to the maximum extent permissible) whose absence of relevant criminal records has been verified; (c) in strict accordance with the standards and timelines set out in Schedule 1 or Appendix 1, free of defects, errors or faults, in order to meet the Objectives of this Agreement; and (d) in accordance with applicable law including PIPA, rules, regulations and guidelines or policies provided by us. 8.2 You represent and warrant that: (a) upon installation, the Equipment will be compatible with existing equipment and software on our systems and the Equipment will meet all the technical documentation and requirements required to operate the Service in accordance with our requirements and objectives; and (b) you have the right to license all intellectual property rights in a Service, Software and Documents, to us. 8.3 You represent and warrant that you are not subject to any contractual obligation, compliance with which is likely to have a material adverse effect on your ability to perform your obligations and you will notify us immediately if you have any actual or potential conflict of interest which might affect your ability to provide the Service. 8.4 You represent and warrant that this Agreement is executed by you or by your duly authorized Representative and that you have obtained all required authorizations and capacity in order that you can fulfill your obligations. 8.5 You declare that you are in possession of all Consents necessary for the provision of a Service and you will maintain such Consents at all times while providing the Service. 8.6 You shall procure the benefit of any warranties or guarantees in respect of goods and materials you supply to us and provide copies of such warranties or guarantees. 8.7 You declare that all payments to us, including but not limited to, taxes and social insurance, are current. 8.8 You shall provide information or sign any other agreements necessary or as requested by us, in order that either you or we can fulfill their obligations under this Agreement. 8.9 You represent and warrant that you are that a Service does not infringe or misappropriate any patent, copyright, trade secret or other intellectual property right of a third party or breach of any law applicable to it. 8.10 You represent and warrant that you are fully satisfied as to the scope and nature of the Service and of your obligations under this Agreement and that you have the corporate power and authority to enter into, and perform your obligations under, the Agreement.
