Common use of Payday and Pay Advances Clause in Contracts

Payday and Pay Advances. ‌ a. All employees shall normally be paid no later than the first of the month. When a payday occurs on Monday through Friday, payroll checks shall be released to employees on that day. When a payday falls on a Saturday, Sunday or Holiday, employees’ paychecks shall be made available after 8:00 a.m. on the last working day of the month. The release day for December paychecks dated January 1 shall be the first working day in January to avoid the risk of December's paychecks being included in the prior year's earnings for tax. b. Employees will be allowed one (1) pay advance during their first thirty (30) days of employment. c. The Parties agree that pay advances will be kept to an absolute minimum and are for emergencies, but in no instance will an employee be given more than three (3) pay advances in any one calendar year (January 1 through December 31). Within that context, employees may obtain an advance on their salary subject to management's approval. The amount of the request shall not exceed sixty percent (60%) of gross pay earned to date in the month, but shall be at least one hundred dollars ($100.00). Employees may submit requests up to the final monthly payroll cutoff date. Pay advance requests will normally be submitted to the payroll office by the fifteenth (15th) of the month.
