Common use of Payment on Death Clause in Contracts

Payment on Death. Where an employee dies, or the chief executive has directed that an employee is presumed to have died on a particular date, the chief executive may make a payment or partial payment for unused leave credits and other entitlements directly to the dependants or the domestic partner, or to the legal personal representative, or to the estate, of the former employee of an amount that would have been paid had the employee ceased employment otherwise than because of the employee’s death. The payment in respect of unused long service leave is calculated in accordance with subclause E25.23.
