Payments for Leave Days. Payments of accumulated annual leave days prior to a vacation or upon termination of employment will be made in the following manner: (A) An employee who is discharged shall be paid for all accumulated annual leave on the date of the employee’s termination, or as soon thereafter as final time records can be received and processed by the LSNYC fiscal department. (B) An employee who resigns may receive payment for all accumulated annual leave on the date of the employee’s termination if a request for such a payment is made to the LSNYC fiscal department at least two (2) weeks prior to termination. (C) Notwithstanding the above: 1. No employee will be paid for more than forty (40) accumulated annual leave days during the period beginning one (1) month prior to resignation and continuing subsequent thereto. All days above forty (40) will be forfeited. 2. No employee will be paid for more than forty (40) accumulated annual leave days upon termination, other than resignation. All days above forty
