Penalty Fees. Should the CONSULTANT be in breach of any or all of its obligations in providing the Services within time specified under the conditions stipulated in this Agreement, the CONSULTANT consents to pay the COMPANY a penalty corresponding to 0.3% of Contract Price per day, but not exceed 5% of Contract Price. If it appears to the COMPANY that the CONSULTANT does not duly rectify the breach within the reasonable period of time or within the period of time as stipulated in the notice to the CONSULTANT, the COMPANY shall be entitled to terminate this Agreement and to exercise the right to claim in accordance with this clause 12. The imposition of penalty under this clause 12.5 shall not prejudice the right of the COMPANY to claim for compensation due to any breach by the CONSULTANT of this Agreement.
Penalty Fees. 11.1. Penalty Fees apply when an Investor withdraws any amount before the end of the Trading Period.
11.2. The Trading Period is stated in the Manager’s Strategy Offer and it commences as soon as the Investor makes the initial deposit.
11.3. The Penalty Fee is a percentage that is applied on the withdrawal amount.
11.4. The Formula used to calculate the Penalty Fee is:
Penalty Fees. In certain instances, we may charge you a penalty fee up to the amounts shown on your Pricing Schedule. If we do not receive at least the Minimum Payment Due by the Payment Due Date disclosed on your billing statement, we may charge a late payment fee. This fee will never exceed the Minimum Payment Due that was due immediately prior to the date on which the fee was assessed. Each time a payment made to the Account is not honored by your financial institution or cannot be processed, we may charge you a returned payment fee even if the payment is honored after we resubmit it. This fee will never exceed the Minimum Payment Due that was due immediately prior to the date on which the payment was returned to us. We reserve the right to add or modify the penalty fees to which your Account is subject in accordance with applicable law.
Penalty Fees. (i) Each time we do not receive the Minimum Payment Due in full within one (1) day after the Payment Due Date, we will charge you a Late Fee of $27.00. We will never charge you a Late Fee exceeding the Minimum Payment Due that is late.
(ii) Each time a check, instrument or other payment on your Account is returned to us unpaid for any reason or we must return any check or instrument you send us because it is not signed or is otherwise incomplete, we will charge you a Returned Payment Fee of $25.00. We will not charge a Returned Payment Fee if we are charging a Late Fee with respect to the same Minimum Payment Due and will never charge a Returned Payment Fee exceeding the related Minimum Payment Due.
Penalty Fees. (i) If we do not receive a payment from you in at least the amount of your Minimum Payment Due within one
(1) day after the Payment Due Date shown on your monthly statement, you will be charged a Late Payment Fee up to $27 for the first Late Payment and up to $38 for a subsequent Late Payment within the following six (6) months.
(ii) Each time a check, instrument or other payment on your Account is returned to us unpaid for any reason or we must return any check or instrument you send us because it is not signed or is otherwise incomplete, we will charge you a Returned Payment Fee of $25.00.
Penalty Fees. In connection with article 12.5 of the Service Agreement, if CONSULTANT fails to deliver the final report within three (3) months after receipt of Environmental Impact Assessment study, the CONSULTANT agrees to pay a penalty corresponding to 0.3% of Contract Price per day, but not exceed 5 % of Contract Price.
Penalty Fees. 21.01 A penalty fee for late remittance of Dues, Vacation Pay, Pension Fund and Education & Assistance Fund contributions, as well as benefit premiums shall be equal to five percent (5%) of the outstanding amount, compounded and calculated monthly.
Penalty Fees. If you do not sign up to fill your volunteer hours before the end of the six months, you will be charged the Non-Compliance Fee (NCF) of $50 per hour. If you sign up for a position and fail to show up for your shift and have not made arrangements for a replacement, you will be charged the No-Show Penalty Fee (NSF) of $100 per hour missed.
Penalty Fees. The fees listed below are an example of what may be charged if guidelines and usage indicated within the signed contract are not followed, all are subject to change:
Penalty Fees. (a) A late payment of 10.5% or $50, whichever is greater, will be assessed on the unpaid balance until the Grantor receives payment in full. A returned check fee as provided in 11 AAC 05.010, or its successor regulation, will be assessed for any check on which the bank refuses payment. If the bank refuses payment, Grantee will be notified, and the default period will continue to run until payment is satisfied.
(b) Unless otherwise agreed or required by applicable law, payments will be applied first to any unpaid collection costs, late charges, and any unpaid interest, and any remaining amount to the land use fee.
