Common use of PERSONNEL RIGHTS Clause in Contracts

PERSONNEL RIGHTS. A. Pursuant to Act 379 of the Public Acts of 1965, the Board hereby agrees that every employee of the Board shall have the right freely to organize, join and support the Union for the purpose of engaging in collective bargaining or negotiation and other concerted activities for mutual aid and protection. As a duly elected body exercising governmental power under color of the law of the State of Michigan, the Board undertakes and agrees that it will not directly or indirectly discourage or deprive or coerce any secretarial/clerical personnel in the enjoyment of any rights conferred by Act 379 or other laws of Michigan or the Constitutions of Michigan and of the United States; that it will not discriminate against any employee by reason of membership in the Union or non membership, participation or lack of participation in any activities of the Union or collective negotiations with the Board or institution of any grievance, complaint, or proceeding under this Agreement or otherwise with respect to hours, wages and any terms or conditions of employment. The Union likewise agrees that it will not intimidate or coerce any employee covered hereunder in the exercise of their rights set forth herein or under law. B. The Board specifically recognizes the right of its employees appropriately to invoke the assistance of the Employment Relations Commission, formerly the State Labor Mediation Board, or a mediator from such public agency, pursuant to the provisions provided by law. C. The Union and its members shall have the right to use school building facilities for meetings at reasonable hours, outside of the working day. No secretarial/clerical personnel shall be prevented from wearing insignia, pins, or other identification of membership in the Union either on or off school premises. Bulletin boards shall be made available to the Union in areas that are reserved for the exclusive use of secretaries. D. The Board agrees to furnish to the Union, in response to reasonable requests from time to time, all available information concerning the financial resources of the District that has been made public and such other information as will assist the Union in developing intelligent, accurate, informed and constructive programs on behalf of the secretarial/clerical personnel, together with such information that may be necessary for the Union to process any grievance or complaint. E. The Association shall be granted up to ten (10) days release time to conduct association business. If a substitute is required, the Association will reimburse the board for the pay of the substitute.
