Plan Assignments. Notwithstanding Section 8.2(a) (Conditions to Transfer) and subject to obtaining the opinion described in Section 8.2(a)(ii) and the fulfillment of the requirements set forth in Section 8.2(b) (Conditions to Succession to Capital Accounts), the General Partner shall be deemed to consent to the assignment by any Limited Partner that is a trust organized pursuant to one or more employee benefit plans (as defined in Section 3(3) of ERISA) to one or more successor or underlying trusts or fiduciaries of such Limited Partner, of all or any fraction of such Limited Partner’s right to receive all or part of the share of the profits, losses, distributions and returns of Capital Contributions to which such Limited Partner would otherwise be entitled. Following the reconstitution of, or substitution of the fiduciary for, any such employee benefit plan, such plan shall be deemed to be a successor or underlying trust or fiduciary within the meaning of the preceding sentence. The Limited Partner affected by such change shall notify the General Partner in writing of such change promptly and in no event later than after such event. The records of the Partnership and such Limited Partner’s Exhibit A shall be changed by the General Partner to reflect the identity of the new trustee or other fiduciary upon receipt of such notice and the execution and delivery of such documents as the General Partner shall require in connection with such change. Pending the receipt of such notice and documentation, the Partnership and the General Partner shall be entitled to rely on the records of the Partnership for all purposes in connection with the affected interest.

  • Shift Assignments When an opening occurs in a shift assignment in an appropriate work group at a location, preference shall be given to employees within the classification who possess the training, ability and any required special qualifications to perform the work required, on the basis of seniority. In the event that no employee desires a shift assignment, employees shall be selected in order of inverse seniority. This provision shall not apply to necessary training assignments. This provision shall not in itself alter the practice of rotating shifts where such practice presently exists. No employee who has a regular shift assignment on the effective date of the Agreement shall be involuntarily displaced from such shift assignment as a result of this Article.

  • Employee Assignments A. All teachers will be given written notice of their salary schedule and building assignment for the forthcoming year as soon as possible after budget enactment. All teachers will be given notice of their class and/or subject assignments, responsibility assignments and room assignments for the forthcoming year and not later than July 31.
