Common use of Pre-Disciplinary Hearing Timelines Clause in Contracts

Pre-Disciplinary Hearing Timelines. The unit member must respond to the pre-disciplinary notice no later than ten (10) working days after delivery of the written notice. The pre-disciplinary hearing date and time shall be set no sooner than fifteen (15) working days after delivery of the written notice, unless an earlier or later date is mutually agreed upon. After the pre-disciplinary hearing has been concluded and all pertinent facts have been reviewed, the hearing officer shall notify the unit member and his/her representative in writing of the final decision regarding the recommended discipline within twenty (20) working days of the pre-disciplinary hearing. If a unit member of the AFT elects to be represented by the AFT in a disciplinary matter, the unit member shall be allowed to have no more than three (3) AFT representatives present during the pre-disciplinary hearing, consisting of the AFT’s attorney, AFT President, and AFT site representative or Grievance Chair. Only one (1) of these AFT representatives will be allowed to be the spokesperson during the hearing.
