Prevention of Soil Erosion. A. The Facility Owner shall work with Landowners and create and follow a SWPPP to prevent excessive erosion on land that has been disturbed by Construction or Deconstruction of a Facility.

Prevention of Soil Erosion. A. The Facility Owner will work with Landowners to prevent excessive erosion on land that has been disturbed by Construction or Deconstruction of a Commercial Wind Energy Facility. Consultation with the local SWCD by the Facility Owner will take place to determine the appropriate methods to be implemented to control erosion. This is not a requirement, however, if the land is bare Cropland that the Landowner intends to leave bare until the next crop is planted.

Prevention of Soil Erosion. Developer will work with County Engineer and County Drainage Inspector to prevent excessive erosion on lands disturbed by the construction within the Roadway Ditches, Public Roadways and Public Drainage Systems. Developer shall provide to County Engineer and County Drainage Inspector, a copy of their Erosion Control Plan and State of Minnesota National Pollution Discharge Elimination System Permit prior to start of construction. Reasonable methods will be implemented to prevent erosion. If Developer and County Engineer cannot agree upon a reasonable method to prevent erosion on the Roadway Ditches within Public Roadway right-of-way or Public Drainage Systems, an independent engineer shall resolve the dispute as set forth in Articles 7.1 and 7.2 of this Development Agreement.

Consultation with the appropriate County Soil and Water Conservation District by the Owner will take place to determine the appropriate methods to be implemented to control erosion. This is not a requirement; however, if the land is bare Cropland that the Landowner intends to leave bare until the next crop is planted.
Prevention of Soil Erosion. The Developer will work with the County, Townships, Drainage Authority and Watershed District to prevent excessive erosion on Township lands disturbed by the construction within the Right-of-Way of Public Roadways and Public Drainage Systems. The Developer shall provide to the County, Township, Drainage Authority and Watershed District, a copy of their Erosion Control Plan and State of Minnesota National Pollution Discharge Elimination System Permit prior to start of construction. Reasonable methods will be implemented to prevent erosion. If the County, Township, Drainage Authority or Watershed District and Developer cannot agree upon a reasonable method to prevent erosion on the Right-of-Way of Public Roadways or Public Drainage Systems, the opinion of the appropriate County, Drainage Authority, Townships, or Watershed District shall be implemented by the Developer provided that Developer shall have the right to challenge the reasonableness of such method after implementation.

  • Rectification of Safety Hazard Where, because of the existence of a safety hazard, a site has been stopped for a defined period of time and employees sent off site by agreement between Site Managers and any combination of Employee Representative/s, Health and Safety Committee, those people who remain on site to do rectification work will be paid at the rate of double time for all such work.
