PRIVACY AND APPLICABLE LAW. 1. The Cardmember agrees to comply with all applicable exchange control regulations which may be issued from time to time.
2. This Agreement, the performance and construction of its provisions and all matters arising because of the issuance or use of the Card are subject to the laws of the Kingdom of Bahrain and the courts of the Kingdom of Bahrain shall have jurisdiction and be competent to decide over all disputes or matters arising in relation to this Agreement, the Card or other relevant matter. The Cardmember also agrees that AEME may initiate collection procedures or other legal action in any other jurisdiction in which the Cardmember may be resident or domiciled from time to time and agrees to submit to the choice of such jurisdiction.
3. It may not be reasonably possible for AEME to maintain original copies of all vouchers, receipts, records of Transactions and other documents signed by the Cardmember to process any Transaction or other documents signed in connection with the use of the Card. It is AEME’s policy to place the same on microfilm or to maintain the same in electronic form. Accordingly, the Cardmember hereby agrees that such microfilm, electronic records or data maintained in any form by AEME or any copies or prints thereof even if not signed are true, complete and accurate and shall be final conclusive evidence admissible at any court of law to evidence any fact or matter whether related to the Account or to a Transaction or Charge and waives any right to object, dispute or challenge such evidence in any manner. The Cardmember also agrees that any such evidence may be used in any procedure for verification of his or her signature.

b. The Agreement is subject to the laws of the Kingdom of Saudi Arabia and the jurisdiction of the competent committee at the Saudi Central Bank (SAMA).
c. We may pursue collection from the Cardmember and/or the Company in any other jurisdiction in which the Cardmember and the Company may be domiciled
d. We provide credit information relating to the Cardmember or the Company to The Saudi Credit Bureau (SIMAH) and/ or Bayan Credit Bureau on a periodic basis.. The information provided reflects the status as of the most recent Statement and includes information whether Your Account is up to date or overdue. If the Account or the settlement Account is overdue as at the date of such reporting and is subsequently regularized, the status of the Account will only be updated at the time of the next monthly reporting. All changes in Cardmember / Company’s status are updated within a maximum of 30 days. To avoid any adverse credit history with SIMAH and/ or Bayan, the Cardmember and the Company should ensure to make timely payments on the Account. The Company and the Cardmember hereby agree to provide Us with any information that We require including but not limited to Know Your Customer forms, information and supporting documentation for establishing and/or administering The Company / Cardmember Accounts and facilities with Us and update The Cardmember personal information if there are any changes and as may be requested by Us. The Company and Cardmember also authorize Us to obtain and collect information as deemed necessary in regard to the Company and the Cardmember, The Company and the Cardmember accounts and facilities with other lenders through The Saudi Credit Bureau (“SIMAH”), Bayan Credit Bureau and electronically through AL-Elm Information Security Company (“Elm”) and to disclose The Company and the Cardmember information to SIMAH, Bayan and Elm, to Our authorized collection agencies or to any other agency approved by SAMA. All capitalized terms in this document will have the same meaning as defined in the Cardmember Agreement.

The Agreement and, unless it is otherwise agreed between us, all matters arising out of the issue or use of the Card are subject to the laws of the Kingdom of Saudi Arabia, including but not limited to, the Committee for Settlement of Banking Disputes of the Saudi Arabian Monetary Agency (SAMA), and the court of jurisdiction shall be at our sole option. You agree, however, that we may carry on collection procedures in any other jurisdiction in which you may be resident or domiciled from time to time.
c. As per SAMA guidelines, we provide credit information relating to you to The Saudi Credit Bureau (SIMAH) on a monthly basis. The information provided reflects the status as of the most recent statement and includes information regarding whether the Account is regular or overdue. In the event an Account is overdue as at the date of such reporting and the Account is subsequently regularized, the status of the Account will only be updated prospectively, at the time of the next monthly reporting. As per SIMAH, all changes in your status are updated within a maximum of 30 days. To avoid any adverse credit history with SIMAH, you should ensure that you make timely payment of the amount due on the Account.
d. It being not reasonably possible for us to maintain original copies of all vouchers and other papers signed by you in connection with the use of the Card, it is our policy to place the same on microfilm. Accordingly, you hereby agree that such microfilm and/or copies thereof will be acceptable to you as evidence in any court of law to prove the transactions undertaken by you and that you will not object to the use thereof as evidence. Moreover, you agree that such microfilm or copy thereof may be used in any procedure for verification of your signature.

(a) Disclose information about the Company, its Card Account, Transactions and Charges on its Card Account (which may include details of goods and or services purchased) to companies within the American Express group of companies worldwide (including third parties and other organizations which provide relevant services to the Card), to any other party whose name or logo appears on the Card issued to the Company, to any party authorized by the Company, to our processors and suppliers and to organizations which accept the Card in payment for goods or services purchased by the Company and obtain such information from those parties, in order to administer and service the Card Account, process and collect Charges on it, or in accordance with Clause 20 (Privacy and Applicable Law). PRIVACY AND APPLICABLE LAW a. In order to ensure the effective functioning of the Service it may be necessary confidentially to transfer information about your Card account and your transactions under the terms of the Service within the American Express Card Service worldwide and to make such information available to the organisations operating Terminals at which you wish to conduct transactions.
b. The operation of any Terminal is subject to all laws and regulations applicable in the location in which it is situated.
c. This Agreement and matters arising out of your participation in the Service are subject to the laws of Bahrain.

13.3 This Agreement and all matters arising out of the issue or use of the CARD are subject to the Laws of the Islamic Republic of Pakistan.
