PRIVACY AND SECURITY STANDARDS. Definitions. Capitalized terms not otherwise specifically defined shall have the meaning set forth in Section B. Authorized Functions. Contractor may collect, handle, disclose, access, maintain, store, and/or use PII of Consumers, Applicants, Qualified Individuals, Qualified Employers, Qualified Employees, or Enrollees, or from these individuals’ legal representative(s) or Authorized Representative(s), only to perform the required duties described in section 1311(i)(3) of the Affordable Care Act, 45 CFR 155.210(e), the Cooperative Agreement to Support Navigators in Federally-Facilitated and State Partnership Exchanges Funding Opportunity Announcement (“Navigator FOA”), and 45 CFR 155.215(a)(1)(iii), as well as in Contractor’s approved work and project plans described in Contractor’s agreement with NMHIX (the “Contract” or “Agreement”). The required duties that will most likely involve the collection, handling, disclosure, access, maintenance, storage and/or use of PII of Consumers, Applicants, Qualified Individuals, Qualified Employers, Qualified Employees, or Enrollees, or from these individuals’ legal representatives(s) or Authorized Representatives, include the following: Facilitate Consumer Insurance Affordability Program eligibility determination leading in some instances to the selection of a QHP or a referral to HSD for Medicaid or CHIP eligibility determination; Collection of data to facilitate eligibility determination from federal (via the Federal Data Service Hub), state, or individual sources; Provide information and services in a fair, accurate, and impartial manner. Such information must acknowledge other health programs such as Medicaid and CHIP; Provide referrals to any applicable office of health insurance consumer assistance or health insurance ombudsman established under Section 2793 of the PHS Act, or any other appropriate State agency or agencies, for any enrollee with a grievance, complaint, or question regarding their health plan, coverage, or a determination under such plan or coverage; and Provide information in a manner that is culturally and linguistically appropriate to the needs of the population being served by the Exchange, including individuals with limited English proficiency, and ensure accessibility and usability of Health care guide tools and functions for individuals with disabilities in accordance with the Americans with Disabilities Act and Section 504 of the Rehabilitation Act. Harland’s performance under this Fourth Addendum will be subject to Intuit’s then-current privacy and security standards, and Intuit’s suspicious mail handling procedures, the current versions of which are contained in Exhibit D (Comprehensive Security Requirements for Confidential Customer Data and Corporate Information), Exhibit E (Intuit Service Provider Privacy Attachment), and Exhibit F, (Intuit Suspicious Mail Handling Procedures), as well as any specific recommendations that Intuit provides to Hxxxxxx.

Each party agrees to comply with all applicable privacy and security requirements under the Payment Card Industry Data Security Standards (“PCI- DSS”), the Payment Application Data Security Standards (“PA-DSS”), as well as the Card Brand security programs, including the American Express Data Security Operating Policy (“DSOP”) the Discover Information Security & Compliance (“DISC”), the MasterCard Site Data Protection Program (“SDP”), and Visa’s Cardholder Information Security Program (“CISP”), as amended from time to time, and with regard to each party’s use, access, and storage of cardholders’ nonpublic personal information under this agreement. Collectively, the PCI-DSS, PA-DSS, DSOP, DISC, SOP and AIS will be referred to as “PCI Standards”.

Hxxxxxx is responsible for ensuring that all third party suppliers of Addendum Products will also comply with the then-current version of Intuit’s privacy and security standards and mail handling procedures.

Selectron agrees that it will gather, collect, receive, generate, store, use, maintain, transmit, process, import, export, transfer and disclose the Licensee Data substantially in compliance with applicable data protection, security, breach notification and privacy laws, rules, regulations and industry standards to which Selectron is subject. Selectron shall, at all times, use reasonable measures to protect the confidentiality of the Licensee Data in its possession or care, including technical, administrative, and physical safeguards that are appropriate given the nature of the Licensee Data.
PRIVACY AND SECURITY STANDARDS. Selectron agrees that it will gather, collect, receive, generate, store, use, maintain, transmit, process, import, export, transfer and disclose the Licensee Data in compliance with applicable data protection, security, breach notification and privacy laws, rules, regulations and industry standards to which Selectron is subject. Selectron shall, at all times, use reasonable measures to protect the confidentiality of the Licensee Data in its possession or care, including technical, administrative, and physical safeguards that are appropriate given the nature of the Licensee Data. Except as permitted for Aggregate Data under this Agreement, Selectron will not use, rent, transfer, distribute, or otherwise disclose or make available Licensee Data for Selectron’s own purposes or for the benefit of anyone other than Licensee without Licensee’s prior written consent. Selectron shall not sell any Licensee Data for any purpose without Licensee’s written consent. This Section shall survive the expiration of termination of this Agreement.
