Private Label DART Service Level Up-Time. DoubleClick shall use ---------------------------------------- commercially reasonable efforts to ensure that the Private Label DART Service delivers Advertising at [*], calculated on a calendar monthly basis; it being understood that Private Label DART Service Advertising delivery "down" time (calculated as the difference between 100% and the actual percentage delivery of ads) shall exclude time (i) required for routine system maintenance not to exceed thirty (30) minutes in any calendar month that is performed by DoubleClick so long as MediaPlex is notified at least one (1) day in advance, and MediaPlex approves the scheduling which must be during low volume time periods and (ii) resulting from technical malfunctions in either the MOJO Technology (including its interaction with the Private Label DART Service) Target Sites' systems, or any other circumstances beyond DoubleClick's [*] = CERTAIN INFORMATION ON THIS PAGE HAS BEEN OMITTED AND FILED SEPARATELY WITH THE COMMISSION.   • Service Level Service Provider will classify incidents at its own discretion. Such classifications shall be consistent with the priorities Service Provider set for itself as a recipient of services. Incidents classified using this methodology will be triaged as documented in Attachment A.

  • Service Levels (1) DTI shall perform the Services in accordance with the service levels (the "Service Levels") as may be agreed to from time to time in writing by DTI and the Funds (the "Service Level Agreement"). Failure to perform in a manner which equals or exceeds the Service Levels shall result in fee credits ("Fee Credits") or the Funds' right to terminate this Agreement, as set forth in the Service Level Agreement.

  • SERVICE LEVEL DESCRIPTION The Fund Accounting Agreement is hereby amended by deleting the Service Level Description attached thereto and replacing it in its entirety with the Service Level Description attached hereto.
