Common use of Probationary Review Clause in Contracts

Probationary Review. After completing two (2) terms of teaching, in either April or December, depending on the date of hire for the Lab Instructor, the bargaining unit members of the Department will conduct a review of the Lab Instructor’s progress taking into account the factors referred to in paragraphs (a), (b) and (c) of clause 25.4.4 and will make a recommendation in writing to the appropriate Xxxx using the overall ratings noted below. If the Xxxx disagrees with the Department’s recommendation, he/she shall meet with the Department to discuss the matter. If following that meeting, the Xxxx and Department still disagree, the Xxxx shall decide the matter and inform the Department of his/her decision together with a written rationale for it. The Xxxx will advise the Lab Instructor in writing of the decision no later than two weeks following the review. The Lab Instructor’s overall performance will be given a single overall rating as follows: a) Satisfactory – Individual performs all tasks in an acceptable manner. Requires little or normal supervision. b) Fair – Individual performs most tasks satisfactorily but not all and/or requires more than normal supervision. c) Unsatisfactory – Individual fails to perform many tasks. Requires close and frequent supervision. A single overall evaluation for a probationary candidate which is reported as “unsatisfactory” shall be considered as grounds for ending the probationary contract. A single overall evaluation for a probationary candidate which is reported as “Fair” shall require the lab instructor to be informed, in writing, of those areas needing remediation.
