PROCEDURES FOR FILING GRIEVANCES. ‌‌ All grievances must be filed within 25 ten days following the act or omission giving rise to the grievance or within ten days after the occurrence of the incident which initiated the grievance, or within 25 days after the faculty member employee should have reasonably known of the circumstances which gave rise to the grievance. Upon receipt of such request, the Commissioner of Higher Education shall appoint a committee comprised of two members selected by management and two members selected by the bargaining agent to hear the grievance. No employee of the unit from which the grievance originated may be selected by management or the bargaining agent to serve on the committee. The grievance committee shall conduct the hearing at the unit from which the grievance originated and shall arrive at a decision within ten working days following the Uniondate upon which the grievance is heard by the committee. Any decision concurred in by a majority of the members of the grievance committee is final and binding and may not be appealed to arbitration.
