Product Commitment. Producer shall produce one (1) musical composition entitled "Sample Track Title" (the "Composition") embodying Artist's featured performance of a yet-to-be-titled master recording (the "Master") for delivery to Artist for, among other exploitations, the manufacture and distribution of records. For the avoidance of doubt, the Composition provided by Producer to create the Master shall be solely retained and owned by Producer as a pre-existing composition, and the composition made by Artist xxxxxxxxx is a derivative. The territory of this agreement shall be the Universe. Artist acknowledges the satisfactory delivery, receipt, and acceptance of the Master.
Product Commitment. DaVita covenants and agrees that [***] of the DaVita Facilities (the “Committed DaVita Facilities”) will use their reasonable efforts to purchase all of their requirements for acid concentrate (i.e., CitraPure®(Liquid and Dry Acid) Dri-Sate® Dry Acid or RenalPure® Liquid Acid) and bicarbonate (i.e., RenalPure® Bicarbonate Powder or Sterilyte® Liquid Bicarbonate) from Rockwell each calendar year during the Term (the “Product Commitment”). [***] Rockwell’s sole and exclusive remedy against DaVita and the DaVita Facilities for any breach by the DaVita Committed Facilities of the Product Commitment shall be to terminate this Agreement, and in such event Rockwell shall not be entitled to any other relief or remedy whatsoever, including any monetary damages, against DaVita or any of the DaVita Facilities. Rockwell understands and acknowledges that the DaVita Facilities not included in the Committed DaVita Facilities (the “Non-Committed DaVita Facilities”) have not promised or committed to purchase any particular quantity of any of the Products or any particular percentage of their requirements for items such as the Products, and that each of the Non-Committed DaVita Facilities may purchase other products from other vendors and suppliers performing some or all of the same functions as the Products.

Product Commitment. 4.1. Artist’s minimum delivery commitment (“Product Commitment”) during the Term is:
4.2. Each Master shall be technically and artistically satisfactory (with respect to, without limitation, market trends and industry measures) to WM acting reasonably and in good faith. WM shall not be obligated to accept delivery until all materials required by WM (acting reasonably) to use and exploit the Masters are delivered including complete label copy and clearances (where applicable) and subject in each instance to commencement of the relevant Period. The Parties hereby agree that the Product Commitment for each Period shall not be delivered to WM hereunder earlier than commencement of that Period.
4.3. The Artist shall during each Period deliver all recordings embodying the Artist’s performances to WM. If any recording is intended to comprise the Product Commitment, the Artist shall deliver to WM high quality demonstration recordings of any such recording, which shall be of an artistic and commercial standard commensurate with previous recordings released by Artist or accepted by WM (or if no such recordings exist then commensurate with demonstration recordings previously delivered to WM prior to the Exclusive Term.
Product Commitment. Salesforce will provide nCino [***] with access to the [***]. The Objects shall include: [***], as updated from time to time by SFDC, in accordance with the procedures set forth in the definition of “Product Catalog” in the OEM Addendum. The use of the embedded [***] is restricted to powering the Partner Application as defined in the Agreement.
Product Commitment. 4.1 You hereby agree to deliver the following track to us during the Term of this agreement: (track name here)
4.2 Your track must be delivered in either 16 or 24 bit WAV/AIF format and un-mastered.
Product Commitment. 4.1. S-Ray agrees to provide PMI with the manufacturing and distribution commitment from the initial customer by December 31, 2014.
4.2. S-Ray agrees to provide PMI with the manufacturing documentation in order for PMI to meet the delivery commitment to its customer by January 15, 2015.
4.3. In the event customers specify custom designs, PMI and S-Ray will work cooperatively to integrate those designs into the product in a prompt manner.
4.4. S-Ray agrees to pay PMI non-recurring charges to enable manufacturing of the above mentioned products.
Product Commitment. Section 3(b) of the Agreement is hereby amended by inserting the following at the end of such section: “ROCKWELL’s only remedy for a breach of the provisions of this Section 3(b) by DAVITA shall be to terminate this Agreement in accordance with the terms and conditions of Section 9(a) of this Agreement, and in such event ROCKWELL shall not be entitled to any other relief or remedy whatsoever, including without limitation monetary damages.”
Product Commitment. For a period beginning on the Effective Date and continuing until December 31, 2002, Elastic agrees to purchase at least 70% of its AFEs from TI if such AFEs are made available to Elastic by TI or an authorized TI distributor; provided however, that (i) the Parties mutually agree in good faith on commercially reasonable supply terms, (ii) TI is not in breach of the terms and conditions of the terms and conditions of this Amended and Restated Agreement, and (iii) TI provides an AFE that meets the specification mutually agreed upon by the Parties in every material respect. Product Commitment. During the term of this Agreement, ACS agrees that it will order fifty percent (50%) of its Product requirements from Prima Pharm, provided that Prima Pharm is in full compliance with the terms of this Agreement.
