Product Royalty. With respect to actual Net Sales of Licensed Products during the License Term, within sixty (60) days following the close of each calendar quarter, Otsuka shall pay to GW Pharma a product royalty, subject to applicable adjustments, if any, equal to (i) *** percent (***%) of actual Net Sales during such calendar quarter by itself and its sublicensees or (ii) *** percent (***%) of actual Net Sales during such calendar quarter by itself and its sublicensees at any time that there does not exist a Valid Claim which would be infringed by the making, using or selling of such Licensed Product but for the licenses granted pursuant to this Agreement (the “Product Royalty”).
Product Royalty. Pharsight will pay Xxxxxxxx a royalty of [ * ] for each annual Customer subscription license allowing use of the Product. No royalty will be due for evaluation licenses allowing a Customer limited use of the Product, provided Pharsight receives no revenue for such evaluation licenses, or for use of the Product in Customer training programs.

Product Royalty. In consideration of the rights granted by Meiji to Xxxxx under Section 2.1, Xxxxx shall pay to Meiji a royalty on Net Sales of the Products (“Royalties”) at a royalty rate equal to [***] percent ([***]%) on a Product-by-Product and country-by-country basis during the Royalty Term. Upon the expiration of the Royalty Term for a given Product in a given country, no further royalties shall be payable on Net Sales of such Product in such country.

Product Royalty. Silan Micro shall pay Sipex for each Licensed Product sold an amount (the "Royalty") equal to the greater of: (A) [+] percent [+]%) of the [+] or (B) [+] percent [+]%) of the [+].
Product Royalty. Further, Convergen hereby grants to IRI and agrees to pay to IRI, its successors and assigns, a perpetual running royalty equal to one-percent (1%) of all Net Sales of Licensed Products (as such capitalized terms are defined below), made by Convergen, its sublicensees, successors, assigns, and Affiliates (defined below). For avoidance of doubt, in the event that Convergen ever owes a royalty upon product sales to the Board of Regents of the University of Texas System, University of Texas MD Xxxxxxxx Cancer Center, or Introgen Therapeutics, Inc., or their successors or assigns, pursuant to the Introgen-IRI Sublicense Agreement, the 1994 MDA License, or the 2006 MDA License, as same may be amended from time to time hereafter, or under any other agreement providing for payment of royalties, with respect to the Licensed Technology or any component thereof, or would owe such a royalty if any of any of such agreements continued in effect at that time, then Convergen will also owe the one-percent (1%) royalty to IRI provided herein. This royalty obligation shall continue for twenty-one (21) years after termination of the last to terminate of the MDA License Agreements and the Introgen-IRI Sublicense. This royalty obligation is not dependent upon the validity or existence of any patent.
Product Royalty. Contract Year 1: $144,000 annually (minimum) Contract Year 2: Greater of: $8,000/month or 110% of the average monthly number of units shipped in Year 1/month. Contract Year 3: 110% of the average number of Royalty Units shipped in Year 2. Renewal Terms: Negotiable, but not less than $5,000 per month. In the event the monthly amount exceeds the minimum, then Mannatech will pay a royalty on a per Royalty Unit basis. The cost will be adjusted down as follows: 1-540,000 Units = $1.00 per Royalty Unit 540,001 - 1,540,000 = .90 per Royalty Unit Over 1,540,000 = .80 per Royalty Xxxx
Product Royalty a. Calculation - Subject to the terms hereof, ART shall pay EDI a royalty ("Product Royalty") equal to Two and One-Half Percent (2.5%) of any and all Net Product Sales Revenues arising from Sales of Products made during the Product Royalty Term.
b. Payment - Subject to the terms of Section 4, the Product Royalty shall be calculated for the Twelve-month period ("Year") commencing October 1, 1997 and ending September 30, 1998 and each subsequent Year during the Product Royalty Term, on the basis of Sales of Products made during such recently completed Year, and shall be due and payable within Thirty (30) days after the end of each Year of the Product Royalty Term.
Product Royalty. The Company shall pay to the Licensor a running royalty --------------- of two percent (2.0%) on the Net Sales of Licensed Products sold by the Company or its Affiliates to Third Parties (the "Product Royalty"). Sales shall be considered to be made, for purposes of this Section, when payment for a Licensed Product is received by the Company. Only one Product Royalty shall be paid for each Licensed Product sold, despite the number of Patent Rights or Valid Patent Claims that may be applicable to the Licensed Product.
