A teacher who is in substantial disagreement with the contents of any material placed in his personnel file after the date of initial employment or with the contents of any formal evaluation may file a grievance in accordance with the procedures set forth in this Agreement, subject, however, to the following limitations and guidelines, namely:
1. A teacher may not proceed to Step 2 of the grievance procedure without the expressed approval of the Executive Committee of the Association.
2. If the Executive Committee agrees that the grievance may be pursued, then and in that event the Association shall first refer the matter to a hearing panel, as hereinafter defined, within ten (10) work days from the date on which the teacher filed with the Superintendent, or his designate, a statement setting forth the ground of his disagreement as provided in Article III, F or Article XIII, E.
3. The hearing panel shall be comprised of the Superintendent, who shall be the convener, an Association representative selected by the Association subject to the approval of the teacher, during the course teacher's Principal, and a representative of the reprimand conferenceBoard of Education selected by the Board. The teacher shall have the right to be in attendance and to speak on his own behalf.
4. Within ten (10) work days after the matter is referred to the hearing panel, requests such representation. If the convener shall schedule a teacher so requests an Association Representativehearing, then the administrator purpose of which shall cease any further discussion be to review the grounds of the situation until teacher's disagreement and to provide an Association Representative is presentopportunity for the parties to reach an understanding and/or to make whatever adjustments are deemed appropriate under the circumstances.
5. Teachers shall not use their students outside of class hours to enhance their political and private aspirations, unless approval has been obtained from the parents of these students and the principal has been notified before the occurrence.
