E. When the teacher objects to the appropriate amount of the school year. The remedies of such procedures shall be exclusive, and unless and until such procedures, including any administrative or judicial review thereof, shall have been exhausted, no dispute, claim or complaint by an objecting teacher concerning the application and interpretation of this Article shall be subject to the grievance procedure set forth in this Agreement, or to any other administrative or judicial procedure.
F. With respect to all sums of money deducted by the District pursuant to authorization of the teacher, whether professional dues or benefit fee, the District agrees to transmit such sums to the Association no later than the fifteenth (15th) day from the final checkdate of said deductions, with itemized printout, to the Association Treasurer. If Provided, that the Association shall maintain a direct deposit account at a financial institution of its choice for purposes of receipt of funds are deducted pursuant to this Article. Transmission of funds to said financial institution shall constitute performance of the District’s obligation under this paragraph.
G. The Association agrees to indemnify and save the Board of Education, including each individual school board member and all authorized agents of the District, harmless against any and all claims, demands, costs, suits, or any other forms of liability (including back pay and all court or administrative agency costs), that may arise out of or by reason of, action taken or not sufficient, taken by the school district District for the purpose of complying with this Article.
1. The District will not incur any expenses, damages, or outlay of money which may be responsiblesustained by enforcement of this Article.
2. H. An employee who, because of sincerely held religious beliefs or due to adherence to teachings of a bona fide religion, body, or sect which has historically held conscientious objection to joining or supporting labor organizations, shall not be required to join or maintain Association membership or otherwise financially support the Association as a condition of employment. However, such employee shall be required, in lieu of periodic dues, service fees and/or initiation fees, to make a donation equivalent to the service fee, to the Xxxxxxx Education Association’s Scholarship Fund.
I. This Article shall be effective retroactively to the date of this Agreement and all sums payable shall be determined from said date.

If a member who is covered by the maintenance of membership requirement withdraws authorization for dues deduction and/or refuses to provide the Association with a lump sum cash payment of dues for the year, the District shall deduct membership dues as provided in Education Code Section 87833.
3. Any unit member newly employed July 1, 1986 or after, who is not a member of the MCFA/CTA/NEA or who does not make application for membership within thirty (1530) days written notice prior from the date of commencement of assigned duties within the bargaining unit, shall become a member of the Association or pay to the effective Association a fee in an amount equal to unified membership dues, initiation fees, and general assessments as a condition of employment. Payments to the Association shall be made in one (1) lump-sum cash payment in the same manner as required for the payment of membership dues, unless, however, the unit member authorizes payroll deduction for such fees in the same manner as provided in paragraph 1 of this Article. Adjunct credit and noncredit professors teaching less than 6 units are exempted from the agency fee provisions herein.
4. Any unit members hired on or after July 1, 1986, whose traditional tenets or teachings include objections to joining or financially supporting employee organizations shall not be required to join or financially support MCFA/CTA/NEA, except that such unit member shall pay, in lieu of a service fee, sums equal to such service fee to one of the non-religious, non-labor organizational, charitable funds listed below:
a. The Merced College Foundation
b. The American Cancer Society
c. The Heart Association
d. The United Way or one of its member organizations
5. Proof of payment to one of the designated charitable funds and a written statement of objection, pursuant to paragraph 4 above, shall be made on an annual basis to the Association as a condition of continued exemption from the provisions of paragraphs 2 and 3 of this Article. The statement of objection shall not be subject to rejection by the Association. Payments shall be in the form of receipts and/or canceled checks indicating the amount paid, date of payment, and to whom payment in lieu of service fee has been made. All information as listed above shall be presented on or before thirty (30) days from the date of commencement of assigned duties within the bargaining unit.
6. With respect to all sums deducted by the District pursuant to paragraphs 2 and 3 above, whether for membership dues or service fee, the District agrees to promptly remit such changemonies to the Association or its affiliate. Upon request and within ten (10) working days, the District agrees to provide the Association with a list of those members for whom dues have been deducted. In the event that a unit member does not pay such fee directly to the Association or does not authorize payment through payroll deduction as provided in paragraph 1, the Association shall so inform the District, and the District shall begin (as soon as possible) automatic payroll deduction as provided in Education Code 87833 and in the same manner as set forth in paragraph 1 of this Article. There shall be no charge to the Association for such mandatory agency fee deduction. Adjunct credit and noncredit professors teaching less than 6 units are exempted from the agency fee provisions herein.
4. 5. PROFESSIONAL DUES AND PAYROLL DEDUCTIONS. A. The Board agrees Any teacher who is a member of the Association, or has applied for membership may sign and deliver to deduct from the salaries District an assignment authorizing deduction of its teachers’ professional dues and assessments uniformly required for continuing membership in the Association. Pursuant to such authorization, as said teachers individually and voluntarily authorize the deduction District shall deduct one-ninth (1/9) of such membership duesdues from the second regular check of the teacher each month for nine (9) months beginning in September and ending in May. Any teacher who shall not perform services for any entire month of the school year shall have his/her dues reduced by one-ninth (1/9) of the yearly dues for such entire month he/she did not render service, except where failure to perform service for any month was a result of the teacher taking a leave of absence or sick leave provided by this Agreement. Dues and assessments will be set in September of each year.
B. If Any teacher who is not a member of the Association changes the dollar amount of its in good standing or who does not make application for membership dues, the Association will give the Board fifteen within thirty (1530) days written notice prior to from the effective date of such change. If the teacher fails to remit the fee or fails to authorize deduction for same, the Association may request the District to make the deduction.
E. When the teacher objects to the appropriate amount of the school year. In representation service fee, the event I leave the employment amount of the district prior to full payment deduction contested shall be placed in an escrow account as required by law until a determination of the authorized amountappropriate amount of the deduction has been determined. The teacher contesting the appropriate amount of the fee to be deducted, any unpaid balance must exhaust the internal administrative procedures of the Association. The remedies of such procedures shall be exclusive, and unless and until such procedures, including any administrative or judicial review thereof, shall have been exhausted, no dispute, claim or complaint by an objecting teacher concerning the application and interpretation of this Article shall be subject to the grievance procedure set forth in this Agreement, or to any other administrative or judicial procedure.
F. With respect to all sums of money deducted by the District pursuant to authorization of the teacher, whether professional dues or benefit fee, the District agrees to transmit such sums to the Association no later than the fifteenth (15th) day from the final checkdate of said deductions, with itemized printout, to the Association Treasurer. If Provided, that the Association shall maintain a direct deposit account at a financial institution of its choice for purposes of receipt of funds are deducted pursuant to this Article. Transmission of funds to said financial institution shall constitute performance of the District’s obligation under this paragraph.
G. The Association agrees to indemnify and save the Board of Education, including each individual school board member and all authorized agents of the District, harmless against any and all claims, demands, costs, suits, or any other forms of liability (including back pay and all court or administrative agency costs), that may arise out of or by reason of, action taken or not sufficient, taken by the school district District for the purpose of complying with this Article.
1. The District will not incur any expenses, damages, or outlay of money which may be responsiblesustained by enforcement of this Article.
2. 1. B. If the Association changes the dollar amount of its unified membership dues, initiation fees, and general assessments to the Association. Pursuant to such authorization, the District shall deduct one-tenth (1/10) of such dues from the regular salary warrant of each full-time unit member each month for ten (10) months, and one-tenth (1/10) of such dues from the regular salary warrant of each adjunct faculty member for each of five (5) months during each contracted semester. Deductions for unit members who sign such authorization after the commencement of the school year shall be appropriately prorated.
2. The Association and the District agree that any unit member who is a member of the Association will give at the Board fifteen time this Agreement becomes effective or who enrolls during the term of the Agreement shall maintain such membership for the duration of this Agreement. This provision shall not deprive any member of the right to terminate their membership within the 30-day period following expiration of the Agreement. If a member who is covered by the maintenance of membership requirement withdraws authorization for dues deduction and/or refuses to provide the Association with a lump sum cash payment of dues for the year, the District shall deduct membership dues as provided in Education Code Section 87833.
3. Any unit member newly employed July 1, 1986 or after, who is not a member of the MCFA/CTA/NEA or who does not make application for membership within thirty (1530) days written notice prior from the date of commencement of assigned duties within the bargaining unit, shall become a member of the Association or pay to the effective Association a fee in an amount equal to unified membership dues, initiation fees, and general assessments as a condition of employment. Payments to the Association shall be made in one (1) lump-sum cash payment in the same manner as required for the payment of membership dues, unless, however, the unit member authorizes payroll deduction for such fees in the same manner as provided in paragraph 1 of this Article. In the event that a unit member does not pay such fee directly to the Association or does not authorize payment through payroll deduction as provided in paragraph 1, the Association shall so inform the District, and the District shall begin (as soon as possible) automatic payroll deduction as provided in Education Code 87833 and in the same manner as set forth in paragraph 1 of this Article. There shall be no charge to the Association for such mandatory agency fee deduction. Adjunct credit and noncredit professors teaching less than 6 units are exempted from the agency fee provisions herein.
4. Any unit members hired on or after July 1, 1986, whose traditional tenets or teachings include objections to joining or financially supporting employee organizations shall not be required to join or financially support MCFA/CTA/NEA, except that such unit member shall pay, in lieu of a service fee, sums equal to such service fee to one of the non-religious, non-labor organizational, charitable funds listed below:
a. The Merced College Foundation
b. The American Cancer Society
c. The Heart Association
d. The United Way or one of its member organizations
5. Proof of payment to one of the designated charitable funds and a written statement of objection, pursuant to paragraph 4 above, shall be made on an annual basis to the Association as a condition of continued exemption from the provisions of paragraphs 2 and 3 of this Article. The statement of objection shall not be subject to rejection by the Association. Payments shall be in the form of receipts and/or canceled checks indicating the amount paid, date of payment, and to whom payment in lieu of service fee has been made. All information as listed above shall be presented on or before thirty (30) days from the date of commencement of assigned duties within the bargaining unit.
6. With respect to all sums deducted by the District pursuant to paragraphs 2 and 3 above, whether for membership dues or service fee, the District agrees to promptly remit such changemonies to the Association or its affiliate. Upon request and within ten (10) working days, the District agrees to provide the Association with a list of those members for whom dues have been deducted. The Association agrees to advise refund to the Board, through the district's business office, of the amount of dues of each Association member wishing dues deduction or District any change therein.
