Dues Deduction Authorized. A. The school district shall deduct from the salaries of teachers, such monies for the exclusive representative as said teachers individually authorize for the school district to so deduct. Commencing in September and each month thereafter, the school district shall deduct in equal installments the monies that the teacher has agreed to pay the exclusive representative during the period provided in the individual’s authorization. New authorizations, when received by the school district during the school year, will be deducted in equal installments over the remaining monthly payments of the teacher’s current contracted salary. B. The secretary of the exclusive representative will certify to the school district the current rate of membership dues and the names of individuals who have joined the exclusive representative. C. The school district shall transmit all deducted monies, along with a list of names for whom deductions are made to the secretary-treasurer of the exclusive representative on a monthly basis.

Dues Deduction Authorized. Upon written authorization of a teacher within the bargaining unit, the District shall deduct from the pay of the teacher the monthly amount of dues as certified by the Secretary of the Association and shall deliver the dues to the Treasurer of the Local Association. The Association's membership application form will serve as the recognized authorization form. The Association shall certify the amount of the annual dues to be deducted. Those wishing to have dues deducted from salaries in equal installments shall notify the District Clerk prior to the first pay day of the current school year. Any teacher hired after the school year begins shall have five (5) weeks to make this same notification. Dues deduction authorizations received during the school year will be prorated over the remaining payments of the employee's current salary.

The MFPE membership form shall serve as the dues deduction authorization form. The amount authorized by teachers who submit their authorizations to the Board after October 1 shall be prorated so that the full amount authorized is deducted, in equal payments, by the end of the school year.

(3) The representation fee is a condition of employment and any employee who chooses not to be a member and refuses to authorize payment of said fee through payroll deductions within thirty working days after the date of their employment, shall be terminated from employment in the District. The Association shall provide notice to the Board Chair when an employee fails to authorize payment within the required timelines and at the next regularly scheduled board meeting following such notification, the board will take action to terminate the employee who has not complied with Article 4.1 of the Collective Bargaining Agreement. (4) The Board agrees to withhold said money by deduction from earnings of representation fee payers in the same manner as it does with the dues of Association members. Employees with a bona fide religious objection will have the so objected portion(s)of their rep fee donated to the East Helena Quality Education Foundation (EHQEF). (5) The Association agrees to indemnify and hold harmless the School District, the Board, each individual Board member and all administrators against any and all claims, suits, or other forms of liability, and all court costs arising out of the provisions of this Agreement between the parties for dues and fee deduction.
