Professional Personnel Records. A. The Board and the Association agree that the Superintendent's office will maintain a personnel file on each teacher employed by the district. The personnel file will consist of all records, evaluations, honors, letters, and notations made on a teacher during his/her employment as well as pre-employment materials concerning such teacher. The District may develop a procedure to purge this file of pre-employment materials no longer deemed necessary to maintain and/or to discard all such pre-employment materials. Such personnel file may be accessed and copied to the extent permitted by law, but the original and any part of these files may not be taken from the administrative offices. B. He/She shall also have the opportunity to reply to such critical material in a written statement to be attached to the filed copy. Access to the teacher's file will be restricted to the teacher, administrators employed by the district, the Superintendent's secretary, and person(s) authorized in writing by the teacher. Access to other person(s) not authorized by the teacher shall be minimally twenty-four (24) hours after teacher receives notification from the Superintendent.

Material other than routine evaluations as covered in Article 4 will be removed from the teacher’s personnel and business files his/her file when a teacher demonstrates claims that it is inaccurate, does not comply with this Article, inaccurate or is unfair as sustained by the Grievance Proceduregrievance procedure. A teacher shall be entitled to a copy copy, at his/her expense, of any material in said teacher’s personnel or business file. Material added to a teacher’s file after the initial copies have been made will also be copied for the teacher(s) upon the request of the teacher(s). Copies shall be provided at no cost to the individual teacher.
G. Whenever any person not acting on behalf of the Board or a teacher seeks to examine the teacher’s personnel or business file (or parts thereof), the teacher shall be notified by sending a letter to his/her last known addressfile.

When materials other than certificates, credentials, evaluations, salary notices, contracts, or materials of a similar nature are to be placed in a teacher's personnel record file, the affected teacher and a representative of the FHTA shall supersede sign a statement attesting their awareness of the forwarding of such material to be placed in his/her personnel record file. Such notice shall include the date, nature of the material, and render inapplicable Ohio Revised Code Chapter 1347, as now or hereafter amendedsignatures of all parties.
