Promotions within a facility. A nurse subject to 4 paragraph a above as of December 14, 2009, who assumes a position at 5 the Medical Center outside of the bargaining unit will retain her/his 6 respective status (as a nonmember, a member whose membership must 7 be maintained, or one of the two options listed in 2.a. (ii) or (iii) below) if he 8 or she returns to the bargaining unit within one year of the date that the 9 nurse assumed a non-bargaining position. A nurse who returns to the 10 bargaining unit after one year will be subject to the choices in 11 paragraph 2.a below.

(ii) 2(a)ii or (iii) 2(a)iii below) if he 8 or she returns returnsthey return to the 19 bargaining unit within one year of the date that the 9 nurse clinician 20 assumed a non-bargaining position. A nurse clinician who returns to the 10 21 bargaining unit after one year will be subject to the choices in 11 paragraph 2.a 22 2(a) below.
