Membership and Financial Obligations. 1. The following provisions apply to any nurse hired before December 14, 2009 (“Effective Date”): Membership in the American Nurses Association through the Association shall be encouraged, although it shall not be required as a condition of employment. Notwithstanding the prior sentence, if a nurse hired before December 14, 2009, voluntarily joins the Association or has voluntarily joined the Association as of December 14, 2009, the nurse must thereafter maintain such membership, as an ongoing condition of employment, or exercise one of the two options listed in 2.(a)ii or 2.(a)iii below.

The following applies to any nurse hired before December 14, 2009 25 (“Effective Date”): Membership in the Oregon Nurses Association shall be 26 encouraged, although it shall not be required as a condition of 27 employment. Notwithstanding the prior sentence, if a nurse hired before 28 December 14, 2009, voluntarily joins the AssociationUnion or has 29 voluntarily joined the AssociationUnion as of December 14, 2009, the 30 nurse must thereafter maintain such membership, as an ongoing condition 31 of employment, or exercise one of the two options listed in 2.(a)ii or 2.(a)iii 32 below. 34 2. The following provisions apply to any nurse hired after December 14, 35 2009: 1 a) By the thirty-first (31st) calendar day following the day that the nurse 2 begins working, each nurse must do one of the following, as a 3 condition of employment: 4 i. Become and remain a member in good standing of the 5 AssociationUnion and pay membership dues 6 (AssociationUnion member); or 8 ii. Pay the AssociationUnion a representation fee established by 9 the AssociationUnion in accordance with the law; or 11 iii. Exercise his/her right to object on religious grounds. Any 12 employee who is a member of, and adheres to established 13 and traditional tenets or teachings of a bona fide religion, 14 body, or sect, that holds conscientious objections to joining or 15 financially supporting labor organizations, will, in lieu of dues 16 and fees, pay sums equal to such dues and/or fees to a non- 17 religious charitable fund. These religious objections and 18 decisions as to which fund will be used must be documented 19 and declared in writing to the AssociationUnion and the 20 Medical Center. Such payments must be made to the charity 21 within fifteen (15) calendar days of the time that dues would 22 have been paid. 24 b) The Medical Center will provide a copy of the collective bargaining 25 agreement to newly hired nurses, along with including a form 26 provided by the AssociationUnion that confirms the provisions in 27 B.2.(a) above. The nurse will be asked to sign upon receipt and 28 return the signed form directly to the AssociationUnion. The 29 Medical Center will work in good faith to develop a procedure to 30 retain copies of such signed forms. 32 c) A nurse should notify the AssociationUnion’s Membership 33 Coordinator, in writing, of a desire to change his or her status under 34 the provisions of B.2. Any nurse who is a member of, and adheres to established and traditional tenets or teachings of a bona fide religion, body, or sect, that holds conscientious objections to joining or financially supporting la- bor organizations, will, in lieu of dues and fees, pay sums equal to such dues and/or fees to a non -religious charitable fund. These religious objections and decisions as to which fund will be used must be documented and declared in writing to the ONA and the WVMC. Such payments must be made to the charity within fifteen (15) calendar days of the time that dues would have been paid. 2. Any nurse who does not notify the ONA of their intent not to join the Association as set forth in Section 1(c) above shall be required to do one of the following within ten (10) calendar days following the completion of the first thirty-one (31) days of employment: (a) join the ONA and pay membership dues, (b) pay to the ONA the designated representation fee established by the ONA, or (c) make payments to a charity if objecting to membership or representation fees on reli- gious grounds.
