Proportionate payment on termination. 36.12.1 If, after one week's continuous service of five working days in their first twelve monthly qualifying period, an employee lawfully leaves their employment or their employment is terminated by the employer through no fault of the employee, the employee shall be paid 2.923 hours for each 38 ordinary hours worked at their ordinary rate of wage and such other payments, on a pro rata basis, to which they would have been entitled under this Agreement.
