Protocol for addressing excess low census. The Medical 2 Center will provide to the Association low census data for each nursing unit 3 within fourteen days after the end of each work cycle. If the Association desires 4 to discuss with the Medical Center its concerns regarding excess low census on 6 fourteen days after having received the end-of-cycle low census data. Excess 7 low census is defined as a reduction of at least ten percent of the core scheduled 8 hours in a nursing unit over a span of two consecutive cycles. When they meet, 9 representatives of the Medical Center and the Association shall consider actions 10 to remedy the situation, including: 11 • Allowing nurses to voluntary reduce scheduled hours with continued 12 benefit level and guaranteed return to scheduled hours for a specific 13 number or cycles; 14 • Allowing nurses to voluntarily be removed from the schedule for a specific 15 period of time with continued benefit level and guaranteed return to 16 scheduled hours without utilizing PTO; 18 • Potential reorganization and/or implementation of layoffs as provided in 19 this article. 21 The parties will strive to mutually agree upon appropriate remedial actions at 22 such meeting or within fourteen days thereafter. 23 a. All time that a nurse is prevented from working their 24 scheduled hours because of low census will be included in calculating 25 these percentages, regardless of whether the nurse uses PTO for any of 26 the low census hours. 28 b. Furthermore, whenever a nurse’s scheduled work hours are 29 reduced by more than twenty-five percent in a given cycle because of low 30 census, the Medical Center will seek to provide that nurse, upon written 1 request from the nurse, any available work on the nurse’s regular shift that 2 the nurse is qualified and able to perform.
