Payment of PTO. 10.9.1 PTO will be paid at the time of use at the nurse’s straight-time hourly wage rate on the nurse’s regularly scheduled shift and classification. 10.9.2 All accrued but unused PTO will be paid upon termination. A nurse may also cash out up to the full amount of PTO hours the nurse has accrued but not used during the calendar year, provided that the employee makes an irrevocable election during open enrollment in the preceding year. Such cashout will be paid at any time after the PTO to be cashed out has accrued for the nurse during the calendar year, as a one-time lump sum payment or as a per pay period amount, but in no event later than December 31 of that year. Except as otherwise provided in this Article, a nurse is not required to cash out accrued PTO and may allow it to accumulate for future use or payment upon termination.

Payment of PTO. 14.1.8.1 Payment for unused accrued PTO time will be made to regular full time/part time/weekend package nurses who have completed the three (3) month eligibility requirement in the following circumstances only: - In the case of a nurse leaving employment at the medical center, provided he/she has given appropriate notice. - In the case of a nurse who has involuntarily separated employment. - In the case of a full or part-time nurse or who transfers to PRN (relief) status. - In the case of a FT nurse who transfers to PT or Weekend Package status, the nurse may elect to retain one-half (1/2) of their accumulated PTO hours, up to 80 hours. The remaining PTO hours will be paid. - Upon the death of a nurse, accrued PTO will be paid to the estate of the deceased person. 14.1.8.2 The medical center requires nurses take PTO and will not allow payment for accrued PTO hours except upon termination with proper notice and in accordance with Section 14.1.8.7 of this Article. 14.1.8.3 In the event a nurse who has previously scheduled and taken at least one full shift of PTO during a pay period is called in to work an additional shift by the manager/designee of the department because of staffing issues within the unit/department, the nurse will be allowed to take PTO hours above the budgeted hours for their position. Nurses may elect to have the PTO hours taken off their timecard and use another time, if they choose. Nurses must have met their (3) month eligibility period to qualify for this benefit. This should be utilized on an emergency need only as the purpose of PTO is to allow nurses time away to rest and relax. In the event of a pre-scheduled time-off for at least one entire shift, eligible nurses may elect to take an additional one (1) hour of PTO, from their accrued balance, above their regularly scheduled hours if they are regularly scheduled on shifts between 1500 and 0730. 14.1.8.4 Nurses who leave prior to three (3) months of employment and nurses giving inadequate separation notice will not be paid for any accumulated PTO. Payment of PTO. PTO accrual begins on the first full pay period following date of employment. PTO hours accrue each pay period based on compensated hours. The amount of PTO accrued (balance) and the amount of PTO used in the previous pay period will appear on -weekly paycheck stubs. Employees do not accrue PTO while on suspension, PTO, holiday, bereavement leave, jury duty or a paid or unpaid leave of absence (including, but not limited to, FMLA), or during Short- Term Disability, Long- Length of service determines the rate at which employees will accrue PTO. An employee becomes eligible for the new higher accrual rate on the first day of the pay period following the t rate of pay. Pre-scheduled PTO is compensation. Limits are imposed on the amount of PTO that can be maintained as a balance. Employees are not allowed to accrue PTO beyond the defined maximum accrual cap. This encourages employees to use their PTO and allows the Employer to manage its financial obligations responsibly. Once an employee reaches his/her cap, he/she will not accumulate any more PTO until he/she uses some of the time in the account and drops below the cap. After the balance falls below the cap, an employee will once again begin accruing PTO; however, an employee will not receive retroactive credit for time worked while at the cap limit. Employees who have already accrued their annual maximum accrual will no longer accrue PTO until following calendar year.   • Payment of Prevailing Wages The Contractor and all Subcontractors shall pay all workers on all Work performed pursuant to this Contract not less than the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work as determined by the Director of the Department of Industrial Relations, State of California, for the type of work performed and the locality in which the work is to be performed within the boundaries of the District, pursuant to sections 1770 et seq. of the California Labor Code.

Notwithstanding the foregoing, the entire unpaid principal amount of the Notes of a Series shall be due and payable, if not previously paid, on the date on which an Event of Default shall have occurred and be continuing with respect to such Series, if the Note Trustee or the Holders of the Notes representing not less than a majority of the Outstanding Amount of the Notes of all Series have declared the Notes to be immediately due and payable in the manner provided in Section 5.02. Such notice shall be mailed no later than five days prior to such final Payment Date and shall specify that such final installment will be payable only upon presentation and surrender of such Note and shall specify the place where such Note may be presented and surrendered for payment of such installment. Notices in connection with redemptions of Notes shall be mailed to Noteholders as provided in Section 10.02. The Note Issuer may pay such defaulted interest (plus interest on such defaulted interest) to the Persons who are Noteholders on a subsequent special record date, which date shall be at least five Business Days prior to the payment date.
