PROVISION OF CORRECT INFORMATION. Entities deemed "eligible" for all services must agree to provide consistent and accurate information that is: o Not false, inaccurate, or misleading; o Not fraudulent or involving the sale of counterfeit or stolen items; o Not infringing on any third party's copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy; o Not violating any law, statute, ordinance, or regulation (including without limitation those governing export control, food safety, consumer protection, unfair competition, antidiscrimination, or false advertising); o Not defamatory, trade libelous, unlawfully threatening, or unlawfully harassing; o Not obscene or containing any form of pornography or content otherwise adult in nature or harmful to minors; o Not containing any viruses, Trojan horses, worms, time bombs, cancel bots, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or personal information; o Not creating liability for donateNYC or DSNY in any way; and o Not linking directly or indirectly to, or including descriptions of goods, services, agencies, or business that are: prohibited under this agreement; attempting to sell or are identical to other items for sale on another site/venue; or not already posted on this site.

  • Product Information EPIZYME recognizes that by reason of, inter alia, EISAI’s status as an exclusive licensee in the EISAI Territory under this Agreement, EISAI has an interest in EPIZYME’s retention in confidence of certain information of EPIZYME. For clarification, the disclosure by EPIZYME to EISAI of Product Information shall not cause such Product Information to cease to be subject to the provisions of this Section 9.2 with respect to the use and disclosure of such Confidential Information by EPIZYME.
