Publication for sale. (1) This paragraph only applies to computer software or com- puter software documentation in which the Government has obtained unlimited rights or a license to make an unrestricted release of the software or documentation. (2) The Government shall not publish a de- liverable item or items of computer software or computer software documentation identi- fied in this contract as being subject to para- graph (l) of this clause or authorize others to publish such software or documentation on its behalf if, prior to publication for sale by the Government and within twenty-four (24) months following the date specified in this contract for delivery of such software or doc- umentation, or the removal of any national security or export control restrictions, whichever is later, the Contractor publishes that item or items for sale and promptly no- tifies the Contracting Officer of such xxxxx- xxxxxx(s). Any such publication shall include a notice identifying the number of this con- tract and the Government’s rights in the published software or documentation. (3) This limitation on the Government’s rights to publish for sale shall continue as long as the software or documentation are reasonably available to the public for pur- chase. (2) Upon expiration of the SBIR data rights period, the Government will not exercise its right to publish or authorize others to pub- lish an item of technical data or computer software identified in this contract as being subject to paragraph (l) of this clause if the Contractor, prior to the expiration of the SBIR data rights period, or within two years following delivery of the data or software item, or within twenty-four months fol- lowing the removal of any national security or export control restrictions, whichever is later, publishes such data or software item(s) and promptly notifies the Contracting Offi- cer of such publication(s). Any such publica- tion(s) shall include a notice identifying the number of this contract and the Govern- ment’s rights in the published data.
