Rail Operations (Brown System. Infractions directly related to rail operations will be handled under the Brown System procedure. Disciplinary files for new employees start on a nil basis, that is, without merit points or demerits. To assess the relative gravity of each fault, a pointing system is planned. The number of demerit points imposed depends on the circumstances, the severity of the incident, the previous personal record, the employee's conduct and his behavior. No disciplinary action can be taken against an employee until he has been given a fair, complete and impartial inquiry into the facts and his responsibility has been established. The appropriate Railway authorities will investigate these incidents as soon as possible and will then review them with the affected employees. It is agreed that the investigation will be conducted between seven (07:00) and nineteen (19:00) hours and will be conducted by a Railway Officer. The employee in question may be accompanied by a colleague of his choice to interview the witnesses. In cases where the imposition of disciplinary measures is warranted, the employee will be informed in writing within six (6) business days of the investigation, unless the two (2) parties agree otherwise. A copy will also be sent to the General Chairman of the Union.
