Common use of Re-employment Clause in Contracts

Re-employment. Employees have the right to return to employment at the time of or prior to the expiration of military leave upon notifying the agency head of the desire and availability to return to Commonwealth service, provided the following are met: a. The employee is capable of performing the essential functions of the position. b. For temporary employees, the temporary position has not yet expired. c. For periods of service delineated in Section 4.c. (1) and (4), written application for reemployment is provided to the agency head.
