RECOGNITION AND DESCRIPTION OF THE BARGAINING UNIT. The Cleveland State University hereby recognizes the AAUP-LS as the exclusive representative for the purpose of collective bargaining with respect to all mandatory subjects of bargaining, including wages, hours, terms and other conditions of employment in the bargaining unit, pursuant to certification by the Ohio State Employment Relations Board (SERB) in Case No. 2012-REP-11-0130 dated June 6, 2013. All faculty at Cleveland State University whose primary appointment is with the College of Law with the rank of Assistant Professor, Associate Professor, Professor, Legal Writing Professor and Clinical Professor with the following exceptions: All adjunct, visiting, emeriti and other retired faculty, and all managerial employees, including but not limited to, the Xxxx of College of Law, assistant deans, associate deans, and Director of Legal Writing and Director of Engaged Learning. If, during the term of this agreement, questions arise regarding the bargaining unit status of one or more employees, the parties will meet promptly to discuss the status of the individuals and shall attempt to reach agreement as to their inclusion or exclusion from the Bargaining Unit. If the parties are unable to reach agreement as to the status of any individual within ten (10) working days from the commencement of the discussions, either party may petition the SERB for determination of the status of the position.
