Referral of Assault/Battery. A. The State shall refer all cases involving a xxxx/inmate assault and/or battery, as defined by existing laws, on an employee to the appropriate prosecuting authority.
Referral of Assault/Battery. The Department of Mental Health shall establish a joint Labor-Management Committee to review existing policies and procedures governing the referral of incidents of patient assaults on staff. The Department shall make a reasonable effort to secure the participation of appropriate District Attorney staff. Bargaining Unit 17 shall be permitted at least two representatives on the committee.
