Refund of xxxxxxx money. 3.4.1. (i): If it is decided on the same day to reject all the tenders, the xxxxxxx money of all tenderers shall be refunded immediately after taking decision by the competent authority.
Refund of xxxxxxx money. Xxxxxxx Money Deposit of successful bidder shall be retained till satisfactory completion of supply of buses. Xxxxxxx Money Deposit of unsuccessful bidders shall be returned in original after completing the process of evaluation of bids.
Refund of xxxxxxx money. In accordance with the Investment and Cooperation Agreement and as disclosed in the Announcement, the Xxxxxxx Money in the amount of RMB120,000,000 (equivalent to HK$140,400,000) paid by the Group to Xxxxxxx Xxxxxxxx and Xx. Xxxx shall be refunded to the Group within five working days after settlement of the Consideration by the Group.
Refund of xxxxxxx money a) If the Tender is accepted, the amount of Xxxxxxx Money will be retained and adjusted as a part of the Security Deposit for the due and faithful fulfillment of the contract. The amount of Security Deposit shall be forfeited if the Tenderer(s) fail to observe or comply the said stipulation as mentioned in the tender.

(a) If the Purchaser has not deposited the Additional Xxxxxxx Money Amount with Shareholders’ Counsel as contemplated by Section 3.3(b) and the Closing has not occurred on or prior to the Initial Expiration Date due to Shareholders’ Failure, then Shareholders’ Counsel shall refund the Initial Xxxxxxx Money Amount to the Purchaser in accordance with the Xxxxxxx Money Escrow Agreement.

Notwithstanding anything contained in this Agreement to the contrary, (a) as a condition precedent to Purchaser's entitlement to the Xxxxxxx Money, Purchaser shall execute and deliver to Seller the Release in the form attached hereto as 38 Exhibit H-1, and (b) as a condition precedent to Sellers entitlement to the Xxxxxxx Money, Seller shall execute and deliver to Purchaser the Release in the form attached hereto as Exhibit H-2, provided, however, that Seller shall not be required to execute and deliver to Purchaser the Release in order to be entitled to the Xxxxxxx Money if Purchaser does not also execute and deliver the Release to Seller in the form attached hereto as Exhibit H-1.

Notwithstanding any provision contained in this Agreement to the contrary, as a condition precedent to Purchaser's entitlement to a refund of the Xxxxxxx Money, Purchaser shall (i) execute and deliver to Seller, the Release in the form attached hereto as Exhibit "G", and (ii) deliver to Seller all of the Delivery Items and other documents provided to Purchaser by Seller or Seller's agents pursuant to Section 4.3 hereof and, to the extent not previously delivered to Seller pursuant to other provisions of this Agreement, copies of all surveys, environmental reports, engineering or inspection reports, and appraisals obtained by Purchaser or Purchaser's proposed lenders and delivered to Purchaser with respect to the Property.

Notwithstanding any provision contained in this Agreement to the contrary, as a condition precedent to Purchaser's entitlement to a refund of the Xxxxxxx Money or any Extension Fee paid to Seller, Purchaser shall (i) execute and deliver to Seller, the Release in the form attached hereto as Exhibit "G", and (ii) deliver to Seller all of the Delivery Items and other documents provided to Purchaser by Seller or Seller's agents pursuant to Section 4.3 hereof and, to the extent not previously delivered to Seller pursuant to Section 6.1 hereof, copies of all surveys, environmental reports, engineering or inspection reports, and appraisals obtained by Purchaser or Purchaser's proposed lenders and delivered to Purchaser with respect to the Property.
Refund of xxxxxxx money. If Buyer terminates this Agreement in accordance with any right to terminate granted to Buyer by the terms of this Agreement or if Seller terminates this Agreement for any reason other than Buyer’s default, the Xxxxxxx Money shall be returned to Buyer by the Escrow Holder, and no party hereto shall have any further obligations under this Agreement except for such obligations which by their terms expressly survive the termination of this Agreement (“Surviving Obligations”). In all other events, should the Agreement fail to close for any reason, the Xxxxxxx Money shall belong to Seller and shall be delivered to Seller by Escrow Holder, and no party shall have any further obligations under this Agreement except for the Surviving Obligations. If the Closing occurs, the Xxxxxxx Money will be applicable to the Purchase Price.
