Regular Upgrading Clause Samples
The Regular Upgrading clause establishes the obligation or right for one party to periodically update or enhance certain products, services, or systems covered by the agreement. In practice, this may require a vendor to provide the latest software versions, security patches, or hardware improvements at set intervals or as they become available. This clause ensures that the subject of the contract remains current and effective, addressing issues such as technological obsolescence and maintaining performance standards over time.
Regular Upgrading. Employees upgraded from one wage group to another are to receive a minimum increase of 6¢ per hour, EXCEPT if the max- imum in the next higher wage group is less than the 6¢, in which case the lesser amount shall apply. When employees are upgraded to fill a regular vacancy in the same job they held previously in a higher wage group, they shall be paid the equivalent of the final rate they received while on the higher job. This does not include rates received while on substitution or temporary transfer, except in cases where a temporary vacancy or temporary job is declared regular and posted for applications, and the successful bidder is the employee who has been filling the tem- porary vacancy up to that time. In such cases, the employee’s new rate of pay and any further step-rate increases which the employee is subsequently entitled to receive in the new range, will be based on the date the employee last started temporarily on the higher job.
