Regulatory Compliance and Disclosure. Each Party shall comply with all local, state, and federal regulations regarding Reliability Water Service. This Agreement does not contemplate that a Party is, or is to be considered, the sole or primary source for potable water service or fire protection service for the other Party. If a Providing Party is not in compliance with local, state, or federal regulations concerning potable water service, then Providing Party shall notify the Receiving Party and the Providing Party shall have the right to discontinue service to the Receiving Party for the duration of the time period of noncompliance. A Providing Party that is not in compliance shall notify the Receiving Party within 24 hours, or as soon as possible, if noncompliance with a regulation has occurred. The Receiving Party may request that the Providing Party continue Water Service if such service necessary to protect the public health, safety, and welfare of Receiving Party’s customers.

Regulatory Compliance and Disclosure. Both parties shall at all times endeavor to provide its best effort to comply with all local, state, and federal regulations regarding Emergency Water Service. This Agreement does not contemplate that the Providing Entity will be considered more than an emergency source for potable water service or supplemental potable water resource during an extreme fire protection occurrence to the Receiving Entity. If, for some reason, the Providing Entity is not in compliance with local, state, and/or federal regulations concerning potable Water Service, then the Providing Entity shall have the right to discontinue service to the Receiving Entity for the duration of the time period of noncompliance with such aforesaid regulations.
Regulatory Compliance and Disclosure. Each Party shall comply with all local, state, and federal regulations regarding wastewater collection and transmission systems. Lakeland agrees to comply with all state, regional, and federal requirements and rules applicable to the provision of Bulk Wastewater Service to the public. Neither Party guarantees any special service, quality, capacity, availability or other facility other than what is required to fulfill that Party’s duty of reasonable care to the customers to whom it provides wastewater service.
