Relief from Automatic Stay, Etc. To the fullest extent permitted by law, in the event the Borrower shall make application for or seek relief or protection under the federal bankruptcy code (“Bankruptcy Code”) or other Debtor Relief Laws, or in the event that any involuntary petition is filed against the Borrower under such Code or other Debtor Relief Laws, and not dismissed with prejudice within 45 days, the automatic stay provisions of Section 362 of the Bankruptcy Code are hereby modified as to Agent and each Lender to the extent necessary to implement the provisions hereof permitting set-off and the filing of UCC Financing Statements or other instruments or documents; and Agent and each Lender shall automatically and without demand or notice (each of which is hereby waived) be entitled to immediate relief from any automatic stay imposed by Section 362 of the Bankruptcy Code or otherwise, on or against the exercise of the rights and remedies otherwise available to Lenders as provided in the Loan Documents.

Relief from Automatic Stay, Etc. To the fullest extent permitted by law, in the event that Borrower or Guarantor shall make application for or seek relief or protection under the federal bankruptcy code (the "Bankruptcy Code") or any other Debtor Relief Laws, or in the event that any involuntary petition is filed against the Borrower or Guarantor under such Code or other Debtor Relief Laws and not dismissed with prejudice within forty-five (45) days, the automatic stay provisions of Section 362 of the Bankruptcy Code are hereby modified as to Lender to the extent necessary to implement the provisions hereof permitting set-off and the filing of financing statements or other instruments or documents; and Lender shall automatically and without demand or notice (each of which is hereby waived by Borrower) be entitled to immediate relief from any automatic stay imposed by Section 362 of the Bankruptcy Code or otherwise, on or against the exercise of the rights and remedies otherwise available to Lender as provided in the Loan Documents. In addition, in the event that relief is sought by or against Borrower under the Bankruptcy Code, Borrower agrees not to seek, directly or indirectly, in any ensuing bankruptcy proceeding, any extension of the exclusivity period otherwise available to a debtor under the Bankruptcy Code, including, without limitation, the exclusivity period provided for under Section 1121(b) of the Bankruptcy Code.

Relief from Automatic Stay, Etc. TFC is making the Loan evidenced by the SPV Note and this Loan Agreement in reliance on SPV's express assurances that it shall not attempt to delay or frustrate the exercise of any rights or remedies granted TFC hereunder upon the occurrence of an Event of Default hereunder. In any case filed by or against SPV under the Bankruptcy Code or other Debtor Relief Law, TFC shall have, in addition to any and all rights and remedies available to TFC under this Loan Agreement and/or at law or in equity, the right (and SPV agrees not to interpose any objection thereto and hereby waives its rights with respect thereto) to request and receive from the Bankruptcy Court, or from such other court of competent jurisdiction, immediate relief from the automatic stay imposed under Section 362 of the Bankruptcy Code or any similar provision under any other federal or state law or statute, any stay or other restriction on the rights and remedies of TFC under any of the court's equitable powers, a termination of the exclusive period provided by Section 1121 of the Bankruptcy Code, or by any similar provision of any other federal or state law or statute, and a dismissal of the bankruptcy case or proceeding. In addition, SPV agrees that it will not seek, directly or indirectly, in any case commenced by or against it under the Bankruptcy Code or other Debtor Relief Law, any extension of the exclusivity period otherwise available to a debtor under the Bankruptcy Code including, without limitation, the exclusivity period provided under Section 1121 of the Bankruptcy Code.   • XXXXX-XXXXX AND RELATED ACT PROVISIONS This section is applicable to all Federal-aid construction projects exceeding $2,000 and to all related subcontracts and lower-tier subcontracts (regardless of subcontract size). The requirements apply to all projects located within the right-of- way of a roadway that is functionally classified as Federal-aid highway. This excludes roadways functionally classified as local roads or rural minor collectors, which are exempt. Contracting agencies may elect to apply these requirements to other projects.   • Automatic Payments You can agree with a seller who accepts PayPal to use PayPal as the payment method for future purchases with that seller.   • Approved Leave of Absence With Pay During Vacation When an employee is qualified for bereavement leave, sick leave or any other approved leave with pay during her vacation period, there shall be no deduction from the vacation credits for such leave. In the case of sick leave, this section shall only apply when the period of illness or injury is in excess of two (2) days and a note from a physician may be required. The period of vacation so displaced shall be taken at a mutually agreed time. An employee intending to claim displaced vacation leave must advise the Employer and provide necessary documentation within seven (7) days of returning to work.
