Reports of unusual occurrence. The Concessionaire shall, upon occurrence of accidents or unusual occurrences on the Rail System, send to MOR, by facsimile or e-mail, a report, in a mutually agreed form, stating accidents and unusual occurrences on the Rail System relating to the safety and security of the Users and the Rail System, as soon as reasonably practicable, and in any event no later than 24 (twenty four) hours after such occurrence. A weekly and monthly summary of such reports shall also be sent within 3 (three) days of the closing of each week and month, as the case may be. For the purpose of this Clause 18.13, accidents and unusual occurrences on the Rail System shall include: (a) death or injury to any person; (b) broken or buckled rails; (c) damaged or dislodged fixed equipment; (d) damage to or displacement of traction power conductor; or loss of traction power; (e) any obstruction on the track; (f) communication failure affecting the running of trains; (g) any obstruction or undue congestion in the provision of Reserved Services; (h) smoke or fire; (i) flooding of tracks; (j) any other event rendering the Rail System unsafe and/or unusable for providing the Reserved Services by MOR; and (k) such other relevant information as may be reasonably required by MOR.

A weekly and monthly summary of such reports shall also be sent within 3 (three) three days of the closing of each week and month, as the case may be. For the purpose purposes of this Clause 18.1319.2, accidents and unusual occurrences on the Rail System shall include: (a) death or injury to any person; (b) broken or buckled rails; (c) damaged or dislodged fixed equipment; (d) obstruction in opening/ closing of doors of a coach; (e) failure of cab signaling for more than 5 (five) minutes ; (f) damage to or displacement of traction power conductor; or loss of traction power; (eg) any obstruction on the track; (fh) cancellation of any scheduled train or loss of punctuality of trains by more than 10 (ten) minutes in each case; (i) disablement of any train during operation; (j) communication failure affecting the running of trains; (g) any obstruction or undue congestion in the provision of Reserved Services; (hk) smoke or fire; (il) flooding of tracks; (j) any other event rendering the Rail System unsafe and/or unusable for providing the Reserved Services by MOR; and (km) such other relevant information as may be reasonably required by MORthe Government or the Independent Engineer.

For the purpose purposes of this Clause 18.1320.2, accidents and unusual occurrences on the Rail System Project shall include: (a) death or injury to any person; (b) broken or buckled rails; (c) damaged or dislodged fixed equipment; (d) damage to or displacement of traction power conductor; or loss of traction power; (e) any obstruction on the track; (f) communication signaling and telecommunication failure affecting the running of trainsTrains; (g) any obstruction or undue congestion in the provision of Reserved Services; (h) smoke or fire; (i) flooding of tracks; (j) any other event rendering the Rail System unsafe and/or Project unsafe, unusable and /or causing traffic disruptions for providing the Reserved Services by MORthe Zonal Railway; and (k) such other relevant information as may be reasonably required by MORthe Authority.
